This page explains builder delay case when an LLP is involved: what the law requires, which papers matter, how long it usually takes and what to do first. The firm of Advocate B.K. Singh handles this work from offices in Dwarka, New Delhi and Vaishali, Ghaziabad.

In short. A builder delay case is a complaint by a buyer whose flat, plot or commercial unit was not handed over by the date in the agreement. Under section 18 of RERA you can withdraw and claim a full refund with interest, or stay in the project and claim interest for every month of delay until possession. The complaint goes to the state RERA authority or the consumer commission.

Delayed possession is the most common complaint homebuyers in Delhi NCR bring to a lawyer. The pattern is familiar: the agreement promised possession in three or four years, the date has passed, construction has slowed or stopped, the builder sends cheerful updates and fresh demands, and the buyer is paying rent and an EMI at the same time. Some buyers want their money back. Others have waited this long and want the unit, with fair compensation for the wait.

The law now gives clear remedies. RERA lets you choose between a refund with interest and interest for the delay, and the consumer commission gives a parallel route with its own advantages. If the builder is insolvent, the remedy shifts to the insolvency process. The right choice depends on the stage of the project, the builder's finances, the amount involved and what you actually want at the end: money or the keys.

What a builder delay case is

A builder delay case is a legal claim by a buyer against a promoter who has failed to complete the project or hand over possession by the date promised in the agreement for sale. The buyer asks either for a refund of everything paid with interest, or for possession with interest for every month of delay, and sometimes compensation for losses such as rent paid or extra interest on a loan.

The claim rests on a simple idea: the builder made a time-bound promise in return for your money and did not keep it. Section 18 of RERA turns that into a statutory right. Consumer law treats it as a deficiency in service. In either forum the builder's usual defences are force majeure, delay in government approvals, defaults by other buyers and your own late payments, and the case is largely about testing those defences against the documents.

A delay case can be brought for a flat, villa, builder floor, plot, shop, office or other unit sold by a promoter. It covers RERA-registered projects and, through the consumer commission and in some cases RERA itself, projects that were ongoing when RERA came into force in 2017.

Refund or possession: the first decision

Section 18 gives you two different remedies, and you should pick one deliberately. If you withdraw, the builder must return the entire amount paid with interest at the prescribed rate from the date of each payment, plus compensation where you prove loss. If you stay, the builder must pay interest for every month of delay until it hands over possession, and you remain bound to pay the balance price when possession is properly offered.

Withdrawal makes sense when the project is stalled, the builder's finances are doubtful, the structure is far from complete or you have bought elsewhere. Staying makes sense when the building is nearly complete, an occupancy certificate is close, the unit's market value has risen, or you have a home loan disbursed that would be awkward to unwind. Many buyers change their minds midway, so write your choice down clearly at the start.

A practical test is the builder's progress on the ground over the last year. If slabs are being cast and finishing has started, interest for delay with possession is usually the better bet. If the site has been quiet for months, workers are gone and other buyers are filing complaints, the refund route, filed quickly, protects you better, because buyers who sue first often recover first.

The provisions that decide builder delay cases

Section 18, RERA 2016

If the promoter fails to complete or give possession as per the agreement, the allottee who wishes to withdraw gets a refund with interest and compensation; the allottee who stays gets interest for every month of delay until possession. The interest rate is set by the state rules, in most NCR states the State Bank of India's highest marginal cost of lending rate plus two percent; check the current rule.

Sections 31, 71 and 72, RERA 2016

Section 31 allows a complaint to the authority or the adjudicating officer. In Newtech Promoters v State of UP (2021) the Supreme Court held that the authority can order refund and interest, while compensation is decided by the adjudicating officer under sections 71 and 72, which list factors such as the builder's gain and the buyer's loss.

Sections 40, 43(5), 44 and 58, RERA 2016

Unpaid amounts can be recovered as arrears of land revenue. A promoter appealing to the Appellate Tribunal must first deposit at least 30 percent of the penalty or the full amount payable to the allottee with interest and compensation. Appeals lie within 60 days, and a further appeal to the High Court within 60 days on questions of law.

Consumer Protection Act 2019

Delay in possession is a deficiency in service. The District Commission hears claims where the amount paid is up to 50 lakh rupees, the State Commission up to 2 crore and the National Commission above that. The complaint must be filed within 2 years of the cause of action, and Newtech confirmed that buyers may choose the consumer commission instead of RERA.

Sections 7 and 14, Insolvency and Bankruptcy Code 2016

Homebuyers are financial creditors and can start insolvency against the builder company, but only jointly with at least 100 allottees or 10 percent of allottees in the project. Once insolvency is admitted, the moratorium under section 14 stops RERA and consumer proceedings against the company.

How the delay is counted

Delay runs from the possession date in the agreement for sale, plus any grace period the agreement allows. If the agreement ties possession to an uncertain event, such as the date of approval of building plans or the date of the agreement itself, forums usually fix a reasonable date from the documents or the date declared on the RERA registration. The completion date the builder declared to RERA is also useful, since the builder chose it.

Force majeure is read narrowly. RERA's definition covers war, flood, drought, fire, cyclone, earthquake and other natural calamities. Lack of funds, slow sales, labour shortages and delays in approvals the builder should have planned for are generally not accepted as excuses. For the COVID period, RERA authorities in NCR issued orders extending project timelines, and whether that extension reduces your delay interest depends on the authority's order and the facts of your project.

Delay ends when the builder makes a valid offer of possession. An offer made without an occupancy or completion certificate is generally not a valid offer, and forums have refused to treat it as stopping the delay. Once a valid offer is made, RERA expects the buyer to take possession within two months; refusing a proper offer to keep the delay running does not work.

Interest, compensation and charges the builder cannot impose

Interest for delay under RERA is calculated on the amount you have actually paid, month by month, at the rate in the state rules. Under the Act, the rate payable by the builder for delay must be the same as the rate the builder charges you for late payment. So a clause that charges you 18 percent for late payment but offers you a token amount per square foot per month for delay is not enforceable as written.

In Pioneer Urban Land and Infrastructure v Govindan Raghavan (2019), the Supreme Court held that one-sided clauses in a builder buyer agreement are an unfair trade practice and do not bind the buyer. Consumer commissions apply that reasoning to token delay compensation clauses, excessive forfeiture and unilateral cancellation clauses. Compensation beyond interest, for rent paid, loan interest or harassment, must be proved with documents and is decided by the adjudicating officer under RERA or by the consumer commission.

When possession is finally offered, check the final demand line by line. Forums have repeatedly disallowed holding charges where the delay was the builder's, and questioned increases in super area without a revised sanctioned plan, unexplained escalation, and maintenance charged for periods before a valid offer. Pay undisputed amounts and record your objection in writing on the rest.

How to file a RERA complaint for builder delay

Most delay cases in NCR now go to RERA. The steps are similar in Delhi, Uttar Pradesh and Haryana, though forms and portals differ.

  1. Check the project on the RERA website

Note the registration number, the promoter's name, the completion date declared and any extensions granted. If the project is unregistered, that itself is a violation and affects the forum and remedies.

  2. Send a demand to the builder

A short legal notice stating the agreed date, the delay and your chosen remedy, refund or delay interest, puts the builder on notice. It is not mandatory before a RERA complaint, but it often produces a reply that admits the delay or reveals the builder's defence.

  3. Prepare and file the complaint

The complaint, filed online on the state RERA portal with the prescribed fee, sets out the agreement, the payment history, the delay and the relief. Attach the agreement, receipts and correspondence. File for compensation separately before the adjudicating officer if you want more than interest.

  4. Attend hearings

The authority issues notice to the builder, who files a reply. Hearings are usually short and focused on documents. Keep a calculation of interest ready, payment by payment, since the authority often asks for it.

  5. Enforce the order

If the builder does not pay within the time given, apply for execution. RERA authorities issue recovery certificates to the district collector, who recovers the amount as arrears of land revenue, including by attaching the builder's property.

In delay complaints that reach Advocate B.K. Singh's office, the most common gap is the payment record: buyers have receipts for some instalments and bank entries for others, and the interest claim cannot be calculated until every payment is matched with its date.

The consumer commission route

The consumer commission is a real alternative to RERA, and in some cases the better one. Its jurisdiction depends on the amount you have paid, not the total price: up to 50 lakh rupees in the District Commission, above that up to 2 crore in the State Commission, and above 2 crore in the National Commission. Complaints can be filed online on the e-Daakhil or e-Jagriti portal.

The commission's strength is its wide power over unfair contract terms and its long line of decisions on builder delay, refund and compensation. It can award compensation and costs in the same proceeding, without a separate application. Its weakness is that a buyer who bought for a commercial purpose, such as an investor holding several units, may not qualify as a consumer, and the builder will argue this point.

The two-year limitation is less of a hurdle than it looks. Courts generally treat the builder's continuing failure to deliver as a continuing cause of action, so a complaint is usually within time while possession has not been offered. Once a refund is demanded and refused, or possession is offered, the clock becomes more definite, so file without long delay.

When the builder is insolvent

If the builder company is admitted into insolvency, the rules change at once. The moratorium under section 14 of the IBC stops RERA and consumer proceedings against the company, and orders already passed cannot be executed against it. Your remedy becomes a claim in the corporate insolvency resolution process, filed with the interim resolution professional, usually in Form CA for homebuyers as a class of financial creditors.

Watch for the public announcement, which sets the last date for claims. Missing it does not always end your claim, but it complicates it. The claim should include the amount paid and the interest you are entitled to, with copies of the agreement and receipts. Homebuyers vote through an authorised representative in the committee of creditors, and the resolution plan decides whether you get your unit, a refund, or something in between.

Homebuyers can also start insolvency themselves, but only jointly: at least 100 allottees of the same project or 10 percent of them, whichever is less. Insolvency is a serious step. It can bring in a resolution applicant to complete the project, but it can also freeze everything for a long period. It suits projects that are stalled with no prospect of revival under the present management.

Banks, home loans and subvention schemes

Where your purchase is financed, the bank is a party you must keep informed. Under a normal home loan, your EMIs continue regardless of the builder's delay, and stopping them damages your credit record without hurting the builder. Under a subvention scheme, the builder promised to pay the pre-EMI interest until possession; when builders stopped paying, banks turned to buyers. The tripartite agreement between you, the builder and the bank decides who owes what.

In a refund case, ask the forum to direct the builder to repay the bank's share directly to the bank and the balance to you, with interest on your own contribution. In a delay interest case, claim the extra interest you have paid on the loan as part of your compensation. The Supreme Court has examined complaints about subvention schemes in NCR in recent years and directed investigation into the dealings between some builders and lenders; check the current position if your loan is under such a scheme.

Banks also appear as lenders to the builder. Where a bank enforces its security against the project under the SARFAESI Act, buyers' rights become entangled with the bank's charge. In 2022 the Supreme Court upheld a view that a RERA authority can hear buyers' complaints against a bank that takes over a project under SARFAESI. This area keeps developing, so take advice on the current position before you act.

Getting the order paid

Winning a delay case is half the work; collecting is the other half. Under RERA, if the builder does not comply, the authority can issue a recovery certificate and the district collector recovers the amount as arrears of land revenue. The tehsil staff then attach and auction the builder's property or bank accounts. In Uttar Pradesh, recovery certificates are issued in large numbers and progress depends on how actively they are followed up.

Under the Consumer Protection Act, an order is executed by the commission that passed it, and failure to comply can lead to penalties, including imprisonment, against those responsible. Builders often appeal to delay payment. A builder appealing a RERA order must first deposit the amount ordered or a prescribed portion of it, and the consumer law similarly requires a deposit for appeals, which gives you some security.

If several buyers of the same project hold orders, coordinate. Joint execution applications, information about the builder's other projects and bank accounts, and pressure through the authority's compliance hearings tend to work better than scattered individual efforts. If the builder is heading for insolvency, act quickly, because the moratorium will stop execution.

How the case differs by property type

For a flat in a group housing project, the issues are the possession date, carpet area, the occupancy certificate and the final demand. For a plot in a licensed colony or township, delay often concerns development works such as roads, sewer and electricity, and possession of a plot without services is not true possession. For a builder floor, check whether the building plan permits the floor sold to you, since an unsanctioned floor can never receive a valid completion certificate.

For a shop, office, serviced apartment, hospital, hotel or resort unit, the agreement may include an assured return or lease guarantee in a separate memorandum. Delay in possession and failure to pay assured returns are separate claims, and buyers of commercial units may face the argument that they are investors, not consumers. RERA has no commercial purpose exclusion, which often makes it the better forum for such units.

For terrace rights, roof rights, parking and other add-ons, the delay claim follows the main unit. For land sold as farmhouse or agricultural plots, check first whether the project was a real estate project registrable under RERA; where it was not, the remedy may be a consumer complaint or a civil suit rather than RERA.

How the case differs by buyer

An NRI buyer can file through a power of attorney holder in India, and RERA and consumer hearings increasingly allow video appearance. Refunds should be routed back through the same banking channel used for payment so that repatriation is straightforward. A company or LLP buying units for staff or investment will usually find RERA more suitable than the consumer commission because of the commercial purpose question.

A subsequent buyer who purchased the allotment from an earlier allottee, with the builder's endorsement, generally steps into the earlier buyer's shoes for delay claims. The date from which interest runs, and whether the earlier buyer's past claims passed with the transfer, depends on the transfer documents. Joint buyers should all sign the complaint or authorise one of them in writing.

Where a bank is the claimant, for example after taking over a buyer's rights, or where the buyer's loan account is in default because of the delay, the bank's position needs to be placed before the forum so that the order deals with repayment of the loan. A forum order that ignores the lender leaves the buyer exposed.

Delhi, Noida, Ghaziabad and Gurugram

For projects in Noida, Greater Noida, Yamuna Expressway and Ghaziabad, complaints go to UP RERA, which has its headquarters in Lucknow and an NCR office at Greater Noida. Many of these projects stand on authority land held on lease, so the builder's dues to the Noida, Greater Noida or YEIDA authority can hold up occupancy certificates and registration of conveyance deeds. The state government's policies on stalled legacy projects have offered relief packages in recent years; check how they affect your project.

For Gurugram projects, complaints go to the Haryana RERA authority at Gurugram; for other Haryana districts, to the authority at Panchkula. Licensed colonies in Haryana are governed by licences from the Department of Town and Country Planning, and the licence status matters for occupancy. Delhi RERA deals with projects in Delhi, where private group housing is limited and many disputes concern builder floors, DDA land pooling and smaller projects.

Consumer complaints go to the District Commission for the area where the builder has its office or the cause of action arose, or to the State Commissions in Delhi, Lucknow and Panchkula, or the National Commission in New Delhi, depending on the amount paid. See our pages on consumer complaints in district and state commissions and NCDRC cases.

A typical builder delay case

Here's a made-up example. Anjali and her husband booked a flat in a Greater Noida project in 2019, with possession promised by December 2022 plus a six month grace period. By 2025 the tower has been plastered but lifts, fire systems and the occupancy certificate are pending. They have paid about 85 percent of the price, partly through a home loan, and are paying rent.

Their lawyer checks the RERA page, which shows an extension of registration but no completion. Since the structure is nearly done and the unit's value has risen, the couple decide to stay and claim interest for delay. They file a complaint before UP RERA with a payment-by-payment calculation, and a separate application before the adjudicating officer for rent paid during the delay, supported by rent agreements and bank transfers.

The authority directs the builder to pay interest at the prescribed rate from July 2023 until a valid offer of possession after the occupancy certificate, and allows adjustment of the accrued interest against the final demand. When the builder later sends a possession offer with holding charges and an unexplained area increase, the couple pay the undisputed amount, object in writing to the rest, and take possession under protest while the objection is decided.

Documents for a builder delay case

Purchase documents

  • Application form and allotment letter
  • Agreement for sale or builder buyer agreement
  • Transfer or endorsement papers if bought from an earlier allottee
  • Brochure and price list

Money trail

  • Every payment receipt
  • Bank statements showing each payment
  • Home loan sanction, disbursement letters and tripartite agreement
  • Builder's demand letters and statement of account

Delay evidence

  • RERA project page printouts with completion date and extensions
  • Builder's construction updates and emails
  • Dated site photographs
  • Possession offer letter and final demand, if received
  • Rent agreements and rent receipts, if claiming compensation

Mistakes that cost buyers in delay cases

  • Stopping payments without a decision. If you stay in the project, missing demands that are genuinely due gives the builder a defence and a cancellation threat. Decide on refund or possession first, then act consistently.
  • Signing a no claims undertaking at possession. Builders sometimes make possession conditional on an undertaking giving up delay claims. Forums have often refused to enforce such undertakings, but it is better to take possession under written protest and keep your claim alive.
  • Running parallel cases for the same relief. Filing before RERA and the consumer commission for the same refund invites objections and wasted hearings. Choose one forum for the same relief.
  • Missing the IBC claim date. Once insolvency starts, your RERA or consumer order is frozen. File the claim with the resolution professional on time, with all documents.
  • Not following up the recovery certificate. A recovery certificate does not enforce itself. Track it with the collector's office and the tehsil, and supply information on the builder's assets.
  • Ignoring appeal deadlines. Appeals from RERA orders lie within 60 days, and appeals in consumer cases have their own short periods. Calendar them the day the order is pronounced.

What to do this week if your builder is late

  • Find your agreement for sale and note the possession date and grace period.
  • Print the RERA project page showing the declared completion date and any extensions.
  • List every payment with its date and amount, matched to receipts and bank statements.
  • Decide whether you want a refund or possession with delay interest, and write the reasons down.
  • If the project is quiet and other buyers are filing, do not wait; prepare your complaint now.
  • Keep paying your home loan EMIs and tell the bank in writing about the delay.
  • Check the IBC notices for the builder company in case insolvency has been filed.

A delay case often follows or leads to other work. If you have not signed the agreement yet, a builder buyer agreement review or an allotment letter review can prevent the worst clauses. The complaint itself is covered on our pages on RERA complaint filing and RERA complaints and appeals. When the building is ready, see possession letter assistance, occupancy certificate assistance and conveyance deed registration. If the builder is in insolvency, see insolvency under the IBC.

Costs depend on the forum. RERA charges a prescribed complaint fee; consumer commissions charge fees by claim value, with no fee for small claims up to 5 lakh rupees. Legal fees depend on the number of hearings and whether an appeal or execution follows. Time varies by authority and caseload: many RERA complaints are decided within months to a year or so, consumer cases can take longer at the higher levels, and execution adds its own time.

If you want the papers checked before you act, the team of Advocate B.K. Singh at Legals365 can review them and tell you the next step through our talk to a lawyer page.

When an LLP is a party

A limited liability partnership under the LLP Act 2008 is a body corporate, separate from its partners, with perpetual succession. It owns property, signs contracts and sues in its own name, and a partner's liability is limited to the agreed contribution except in cases of fraud. Every LLP needs at least two designated partners, at least one of whom is resident in India, and the designated partners answer personally for its statutory compliance.

The LLP agreement is the governing document, much like a company's articles. It decides who can sign, how decisions are taken, which matters need the consent of all partners, and how partners join and leave. It must be filed with the Registrar of Companies, and so must every change to it. Each partner is an agent of the LLP for its business, so a third party dealing in good faith can usually hold the LLP to a partner's act. For sale deeds, loans and litigation, though, sub-registrars, banks and courts ask for a partners' resolution or authority letter naming the partner who signs. Check the LLP's master data on the MCA portal: LLPIN, status, designated partners and registered charges.

The difference from an ordinary firm under the Partnership Act 1932 is real. Partners of an LLP are not jointly liable for its debts, and one partner is not personally liable for another partner's wrongful act. That is why lenders and landlords commonly take personal guarantees from LLP partners. The difference from a company matters too: there is no oppression and mismanagement remedy before the NCLT, so partner disputes are settled under the LLP agreement, usually by arbitration, or by a civil suit, and in serious cases by winding up through the NCLT.

Every LLP files an annual statement of account and solvency and an annual return with the ROC. Late filings attract additional fees for each day of delay, and an LLP that has stopped doing business can be struck off. The 2021 amendment decriminalised many defaults, but filings in arrears still block loans, registrations and government contracts at the worst moment. The IBC applies to LLPs, so a creditor can start insolvency proceedings against an LLP that defaults above the threshold.

In practice: name the LLP exactly as registered, ending in LLP; attach the partners' resolution and a copy of the LLP agreement to any deed, lease or plaint; and if the LLP was converted from a firm or a private company, confirm that property held in the old name has been mutated. Conversion vests the assets in the LLP by law, but municipal records, development authorities and sub-registrars still need to be updated before the property can be sold or mortgaged smoothly.

Frequently asked questions

What can I claim if my builder delays possession?

Under section 18 of RERA, you can withdraw and get a full refund with interest and compensation, or stay and get interest for every month of delay until possession. Consumer commissions give similar relief for deficiency in service. Compensation beyond interest must be proved.

What is the interest rate for delayed possession under RERA?

The rate is fixed by the state RERA rules, and in most NCR states it is the State Bank of India's highest marginal cost of lending rate plus two percent. The builder's rate for delay must equal the rate it charges you for late payment. Check the current rule for your state.

Should I file in RERA or the consumer commission?

Both are available, as the Supreme Court confirmed in Newtech Promoters (2021). RERA is specialised and often faster; the consumer commission has wide powers over unfair terms and awards compensation in the same case. Investors and commercial buyers usually do better at RERA.

Is there a time limit for a builder delay case?

A consumer complaint must be filed within 2 years of the cause of action, but continuing failure to deliver is generally treated as a continuing cause. RERA has no fixed limitation period, but long unexplained delay can count against you. File as soon as the delay becomes clear.

Can the builder claim COVID as force majeure?

RERA authorities in NCR issued orders extending project timelines for the COVID period. Whether that reduces your delay interest depends on the authority's order and your project's dates. Delay before or long after that period is not excused by it.

Is a possession offer without an occupancy certificate valid?

Generally no. Forums have held that a possession offer made before the occupancy or completion certificate is not a valid offer and does not stop delay interest. Ask for a copy of the certificate with any possession letter.

Can I stop paying instalments if the builder is late?

Only if you are withdrawing and claiming a refund. If you want the unit, keep paying demands that are genuinely due, because default gives the builder a defence. Raise the delay through a complaint, not by stopping payment.

What happens to my case if the builder goes into insolvency?

The IBC moratorium stops RERA and consumer cases against the builder company. You must file your claim with the interim resolution professional, usually in Form CA, by the date in the public announcement. The resolution plan then decides what you get.

Can I claim rent paid during the delay?

Yes, as compensation, if you prove it with rent agreements and payment records. Under RERA, compensation is decided by the adjudicating officer, while the authority decides refund and interest. Consumer commissions can award it in the same complaint.

Do I lose my claim if I take possession?

No. You can take possession and still claim delay interest, but record a written protest and avoid signing any undertaking giving up claims. Forums have often refused to enforce undertakings taken as a condition of possession.

What if the builder does not pay after the RERA order?

Apply for execution. The RERA authority can issue a recovery certificate, and the district collector recovers the amount as arrears of land revenue by attaching the builder's property. Follow it up actively with the collectorate and tehsil.

Can a group of buyers file one case?

Yes. Consumer law allows a complaint on behalf of numerous consumers with the same interest, and buyers can coordinate RERA complaints. Under the IBC, homebuyers must file jointly, with at least 100 allottees or 10 percent of the project.

Are LLP partners personally liable for its debts?

Generally no. The LLP pays its obligations from its own assets, and a partner is liable only to the extent of his contribution unless he gave a personal guarantee or acted fraudulently.

Can an LLP buy property in Delhi or Noida?

Yes. An LLP can buy, lease and mortgage property in its own name through an authorised partner. Leasehold authorities such as the DDA or the Noida Authority have their own transfer rules and charges, so check those before the deal.
