Circle Rate Advisory For Residential Property

Advice on which circle rate applies to a property, how it sets stamp duty and tax, and what to do if the valuation is wrong.

Circle Rate Advisory For Residential Property raises a familiar set of questions: who has to sign, what has to be checked, where the matter is decided and what it will involve. This page answers them. The firm of Advocate B.K. Singh handles this work from offices in Dwarka, New Delhi and Vaishali, Ghaziabad.

In short. A circle rate is the minimum value per square metre that the state government fixes for property in an area. Stamp duty is charged on the circle rate value or the deal price, whichever is higher, and income tax looks at the same figure. Circle rate advisory means working out the right rate, category and area before you sign, and challenging a wrong valuation.

Every property deal in Delhi NCR has two prices: the one the parties agree, and the one the government says is the floor. That floor is the circle rate (called the collector rate in Haryana and the DM circle rate in much of UP). It decides how much stamp duty you pay, and the Income Tax Department uses it to test whether the price on paper is real. Get it wrong and the cost shows up later, as a deficiency notice from the Collector of Stamps or a tax demand years after the sale.

Circle rate advisory is the work of reading the current notification, placing the property in the right category, measuring the correct area, applying the right use factor and then checking what the number does to stamp duty, registration fee, TDS and capital gains for both sides. It also covers what to do when the Sub-Registrar refers your deed for undervaluation, or when the circle rate itself is out of line with the real market.

What a circle rate is and who fixes it

A circle rate is the minimum rate per square metre (or per hectare for farmland) at which the state will accept that a property has changed hands. If your deed shows a lower price, stamp duty is still charged on the circle rate value. If your deed shows a higher price, duty is charged on the higher price. The circle rate is a floor, never a ceiling.

In Delhi the Revenue Department of the Government of NCT of Delhi notifies circle rates. Residential colonies are grouped into categories A to H, with A the most expensive, and there are separate tables for agricultural land, flats in multi-storey buildings and different uses. In UP the District Magistrate of each district, acting as Collector, issues a district list that goes down to sector, mohalla or village level, usually revised once a year. In Haryana the Deputy Commissioner of each district fixes collector rates, again usually every year, and Gurugram's list is updated often because land values move quickly.

Because each state works differently, the first job in any advisory is to find the notification that is actually in force on the date of execution, not the one quoted by a property dealer or an old website. Rates are sometimes revised mid-year, and a revision a week before your registration changes the duty.

Why the circle rate matters: stamp duty, registration fee and tax

Stamp duty is a percentage of the higher of the consideration and the circle rate value. Registration fee in most of NCR is also calculated on that value, subject to any cap the state has fixed. So if a flat's circle rate value is well above the agreed price, the buyer pays duty and fee on money that never changed hands. The stamp duty advisory and registration fee advisory pages explain the rates and concessions; this page is about the value those rates are applied to.

Income tax uses the same figure. Under section 50C of the Income-tax Act 1961, if the stamp duty value of land or a building exceeds the sale price by more than 10 per cent, the seller's capital gains are computed as if the stamp duty value were the price. The buyer has a mirror provision: under section 56(2)(x), the gap between stamp duty value and price is taxed as the buyer's income if it exceeds the higher of fifty thousand rupees and 10 per cent of the price. For builders and dealers holding property as stock, section 43CA does the same job. From tax year 2026-27 the Income-tax Act 2025 applies, and these rules continue under new section numbers (section 78, section 92(2)(m) and section 53 respectively); your chartered accountant should check the current text.

TDS also follows the higher figure. A buyer of immovable property worth fifty lakh rupees or more must deduct TDS, and since July 2022 the threshold and the deduction are tested against the higher of consideration and stamp duty value. A buyer who deducts only on the agreed price may face a short deduction notice.

Section 47A, Indian Stamp Act 1899 (state versions)

Lets the registering officer refer an instrument to the Collector if the market value appears to be understated, and lets the Collector determine the value and demand the deficient duty, with penalty and interest where the state law provides. Delhi and UP each have their own text of section 47A, and UP's amendments give the Collector wider powers, including action on his own motion within a set period. Read the version that applies to the district where the property lies.

Delhi Stamp (Prevention of Undervaluation of Instruments) Rules 2007

The rules under which Delhi notifies minimum rates for land and construction, use factors for different uses, and the method for valuing flats and built-up property. The circle rate notifications are issued under these rules.

UP Stamp (Valuation of Property) Rules 1997

The basis for the Collector's district list in UP, with separate rates for agricultural land, non-agricultural land, built-up property, flats and commercial property, and additions for features such as road width or corner location where the list provides them.

Section 50C, 56(2)(x) and 43CA, Income-tax Act 1961 (and the 2025 Act)

Tie the seller's capital gains, the buyer's income and a dealer's business income to the stamp duty value, with a 10 per cent tolerance. If the seller says the stamp duty value is higher than fair market value, the Assessing Officer can refer the valuation to a Valuation Officer. Where the agreement was signed earlier and part payment was made by banking channels on or before that date, the stamp duty value on the date of the agreement can be used instead of the value on the date of registration.

Registration Act 1908, section 17

Makes registration compulsory for sale deeds, gift deeds and other documents transferring immovable property worth one hundred rupees or more. Registration is where the circle rate is applied in practice.

How the circle rate value is worked out

For a plot or an independent house in Delhi, the value is usually the land rate for the category multiplied by the plot area, plus a construction rate multiplied by the built-up area, with a use factor that is higher for commercial and industrial use than for residential. For a flat in a multi-storey building, Delhi uses a per square metre rate for built-up area that varies with the size of the flat. Each step has room for error: the wrong category, plot area taken from a dealer's brochure rather than the title deed, built-up area that ignores a sanctioned extra floor, or a residential factor applied to a ground floor shop.

In UP the district list often gives separate rates for land on main roads and inner roads, for different sectors in Noida and Greater Noida, and for flats by area, sometimes with an addition for park-facing or corner units, upper floors or wide roads. Some lists price flats on covered area and others on super area. Using carpet area when the list speaks of super area, or the other way round, is one of the commonest reasons a deed is sent to the Collector.

Agricultural land is usually priced per hectare, by village, with higher rates for land along a highway or within a set distance of a road. If agricultural land has been put to non-agricultural use, or a declaration of non-agricultural use has been made under section 80 of the UP Revenue Code 2006, the non-agricultural rate generally applies. In Delhi, agricultural land circle rates are notified separately and have been revised less often than urban rates, so check the latest notification before you rely on an old figure.

How the answer changes by property type

For a flat in a group housing society, the questions are which area the list uses, whether parking and a share of common areas are valued separately, and whether the floor or facing attracts an addition. For a builder floor in Delhi, the buyer usually gets the floor plus an undivided proportionate share in the land, so the value combines a share of the land rate with the construction rate for that floor. A penthouse often carries an exclusive terrace; whether the terrace is valued, and at what rate, depends on the notification and on how the deed describes it.

For an undivided share in land or a house, the circle rate is applied to the share being transferred, not the whole property, but the share must be stated clearly and must match the title chain. A deed that transfers 'one third share' without saying of what area invites a dispute at the registration counter. For a godown, warehouse or industrial shed, the commercial or industrial rate usually applies, and on agricultural land the question is whether the land is still recorded as agricultural. For a shop, office, hospital, hotel or resort, the commercial rate and use factor apply, and mixed-use buildings may be valued floor by floor.

For leasehold property allotted by DDA, Noida, Greater Noida, YEIDA or GDA, the authority's own transfer charges and conversion charges are calculated on the authority's rates, which are not the same as the circle rate. Stamp duty on the transfer still follows the circle rate. People often confuse the two and budget for one when they will pay both.

How circle rate advisory works, step by step

This is the order in which we check a property before stamp paper is bought or a valuation is challenged.

  1. Identify the property precisely

We start from the title documents, not the brochure: plot or khasra number, sector or colony, area in square metres, built-up area per sanctioned plan, floor, and current use. If the documents disagree with each other, that has to be resolved first, which is often part of title verification.

  2. Find the notification in force

We pull the circle rate notification or district list that applies on the likely date of execution and check whether a revision is pending. In UP we confirm the tehsil and the exact locality entry; in Delhi, the category of the colony and any later corrections.

  3. Compute the value both ways

We calculate the circle rate value and compare it with the agreed price. If the price is lower, we work out the extra duty, the registration fee, the TDS position and the tax effect on both parties so that nobody is surprised later.

  4. Check the deal documents

The agreement to sell and the sale deed should state the consideration honestly, describe the area in the same unit the list uses, and say who bears stamp duty. Where the value is close to a slab or a concession limit, the wording matters.

  5. Plan registration

We fix the e-stamp value, book the Sub-Registrar slot and prepare a short note on valuation to answer questions at the counter. See e-stamp assistance for the mechanics.

  6. Respond to any referral

If the Sub-Registrar refers the deed or the Collector issues notice, we file a reply with evidence of actual condition, area, use and comparable sales, and attend the hearing. If the order is wrong, we file the appeal or revision the state law allows.

If the deal price is below the circle rate

A price below the circle rate is not illegal. Old buildings, distress sales, flats with litigation, plots with access problems and properties in a locality that the list overrates all sell below circle rate. The law simply charges duty on the higher figure and lets the tax department treat the gap as income in some cases. The question is whether the parties understand the cost and have planned for it.

For the buyer, the cost is extra stamp duty and fee, and possibly tax under section 56(2)(x) if the gap is more than the tolerance. For the seller, capital gains are calculated on the circle rate value, so the seller may pay tax on money not received. Either party can ask the tax officer to refer the valuation to a Valuation Officer if the circle rate is clearly above fair market value, and a registered valuer's report prepared at the time of sale is the best support for that request.

When Advocate B.K. Singh reviews a transaction priced below circle rate, the first thing he asks for is the reason in writing: a valuer's report, photographs of the building's condition, a note on pending litigation or encroachment, or evidence that nearby properties have sold at similar prices. That file is what persuades a Collector or an Assessing Officer later. Without it, the only evidence is the circle rate itself.

If the deal price is above the circle rate

Most sales in prime colonies and new projects are registered above circle rate, and that is the safe position. Duty is paid on the actual price, and the tax provisions on stamp duty value do not bite. The risk here is different: the temptation to show only the circle rate value in the deed and take the rest in cash.

Showing a lower price than the real one in a deed is a false statement in a registered document. It can lead to a deficiency demand with penalty if the Collector finds out, it is undisclosed income for the seller, and the cash part may breach the income tax rules that bar cash receipts above small limits in property deals. The buyer also loses: the cost of acquisition for his own future sale will be the lower figure, so he pays more capital gains later. We do not draft documents that understate the price, and we advise clients not to sign them.

When the Sub-Registrar or Collector says the deed is undervalued

If the Sub-Registrar believes the value in a deed is below the market value or the circle rate value, he can register the document and refer it to the Collector of Stamps under section 47A, or in some cases hold back the original deed until the question is decided. The Collector then issues a notice, may inspect the property through the revenue staff, hears the parties and fixes the value. The deficit duty is demanded, often with interest and a penalty if the state law provides for it.

The commonest reasons for a referral are a wrong category or locality, an area unit mismatch, an unrecorded extra floor or basement, commercial use of a residential property found on inspection, and land near a road that the report says should attract the higher roadside rate. Each of these can be answered with documents: the sanctioned plan, the property tax return, the khatauni, photographs and a site plan. A reply that only says 'the value is correct' rarely works.

If the Collector's order is wrong, the state stamp law provides an appeal or revision, usually to the Chief Controlling Revenue Authority or a Commissioner, within a short period. After that, a writ petition under Article 226 can be filed in the High Court where the order is arbitrary or passed without hearing. Pay attention to whether a deposit is needed to file the appeal; in some states it is.

Challenging the circle rate itself

Sometimes the problem is the notification, not the deed. A locality may have been put in a higher category than its neighbours, a whole village may be priced as if it were on the highway, or rates may have been raised sharply without any basis. Many districts publish a draft list and invite objections before finalising it, especially in UP. Filing an objection at that stage, with evidence of actual sale prices, is far cheaper than fighting individual cases later.

Once a list is final, an individual can ask the Collector to treat a specific property differently on its facts, such as a plot without road access or land under a high-tension line. A challenge to the notification as a whole goes to the High Court by writ, and courts are slow to interfere with what is treated as a policy decision unless the classification is clearly arbitrary. For a single property, the targeted route through the Collector and the tax Valuation Officer usually serves better than a writ against the whole list. Delhi High Court matters are described on our Delhi High Court cases page.

How the advice differs by party

A bank as lender relies on its own empanelled valuer and usually lends on the lower of the valuation and the agreement price. A valuation far above circle rate can raise questions in the bank's own audit, and one far below can limit the loan. A bank selling under SARFAESI fixes a reserve price from a valuation report; the auction buyer pays stamp duty on the sale certificate as the state law requires, and should check whether duty is charged on the auction price or the circle rate value before bidding.

An NRI seller faces TDS at capital gains rates, and buyers commonly deduct on the full price unless the seller obtains a lower deduction certificate from the tax department, which is often worth applying for; the circle rate gap feeds into that computation. An NRI buyer usually acts through a power of attorney holder, who must know the circle rate value before buying e-stamp paper. A company or LLP buying or selling property records the value in its books, and the tax audit will test it against the stamp duty value. A builder holding flats as stock is covered by the stock-in-trade rule rather than capital gains.

Family transfers are different. Gifts to close relatives are not taxed as the recipient's income, and several states charge a concessional or fixed duty on gifts within the family, so the circle rate matters less for duty. It still matters for registration, for future capital gains, and for the many family settlements and partitions that are later questioned. See gift deed drafting for how those deeds are framed.

Delhi, Noida, Ghaziabad and Gurugram: practical differences

In Delhi the colony category drives almost everything, and many colonies have been re-categorised over the years. Properties in unauthorised colonies where ownership rights were conferred under PM-UDAY, Lal Dora and extended Lal Dora properties, and DDA flats each raise their own valuation questions. Delhi's circle rates for some categories have long been below market, while in others the market has fallen below them; both situations appear in practice.

In Noida and Greater Noida, the district list for Gautam Buddh Nagar prices sectors separately and has distinct entries for group housing, plotted residential, commercial and industrial land. Transfer of authority leasehold property also needs the authority's transfer memorandum and charges. In Ghaziabad, the district list covers GDA schemes, private colonies and villages, and the line between urban and rural rates near expanding areas such as Raj Nagar Extension needs care.

In Gurugram and the rest of Haryana, collector rates are fixed by the Deputy Commissioner and revised at regular intervals, often with sharp increases in fast-growing sectors. Haryana's registration fee follows its own slab system. Wherever the property is, use the list for that district and the date of execution, and keep a printout or saved copy in the file.

Mistakes that lead to notices and tax demands

  • Using last year's rate. A revision notified a few days before registration applies to your deed. Check on the day you buy e-stamp paper.
  • Wrong area unit. Carpet, built-up, covered and super area are different numbers. Use the one the list uses, and state it in the deed.
  • Ignoring use. A residential house with a ground floor shop or clinic may be valued at a commercial factor on inspection.
  • Unexplained low price. Selling below circle rate without a valuer's report or any written reason leaves both parties exposed to the Collector and the tax officer.
  • Confusing authority charges with circle rates. Transfer charges and conversion charges of DDA, Noida or GDA are separate from stamp duty and follow the authority's own rates.
  • Short TDS. Deducting TDS only on the agreed price when the stamp duty value is higher can lead to a default notice for the buyer.
  • Cash components. Taking part of the price in cash creates tax and penalty risks for both sides and weakens the buyer's position in any later dispute.

A made-up example: an old builder floor priced below circle rate

Here's a made-up example. A family in a Delhi colony agrees to sell the second floor of a forty-year-old house, with an undivided share in the land, for a price about 20 per cent below the circle rate value. The building needs structural repair and there is a dispute with the ground floor owner about the staircase. The buyer's bank agrees to lend only on its own valuation, which is close to the agreed price.

On advice, the seller obtains a registered valuer's report at the time of sale recording the building's age, condition and the pending dispute, and the deed states the correct land share and built-up area. The buyer pays stamp duty on the circle rate value and deducts TDS on that value. The seller reports the circle rate value as the deemed price in his return but asks for a reference to the Valuation Officer, attaching the valuer's report and photographs. The buyer's tax position is reviewed by his accountant on the same evidence. Neither side is surprised, and both have a file ready if a notice comes.

What to do this week

If you are about to buy or sell, get the circle rate value calculated before the agreement is signed, not at the registration counter. Ask who will bear the extra duty if the circle rate is higher than the price, and write the answer into the agreement. If the price is below circle rate, have a registered valuer inspect the property now, while the condition can still be photographed and recorded. Our pages on agreement to sell drafting and sale deed registration explain the next stages.

If you have already received a notice from the Collector of Stamps or the tax department, note the reply date and collect the deed, plan, tax records and photographs. In stamp valuation matters that reach Advocate B.K. Singh's office, the weak point is usually a missed hearing or a one-line reply; a detailed reply with documents and a request for site inspection in your presence changes the result more often than an appeal does. For the income tax side, our income tax notices page covers replies and appeals.

If you want the papers checked before you act, the team of Advocate B.K. Singh at Legals365 can review them and tell you the next step: talk to a lawyer.

Residential property: what changes

Residential property covers houses, builder floors, flats in group housing societies and apartments in developer projects. It is the property people care about most, and the law gives it more protection than commercial premises: consumer remedies against builders, rent control for old tenancies, special rules for senior citizens and family members. It also carries more family disputes than any other kind of asset.

The documents depend on the type. For an independent house or builder floor in Delhi, ask for the chain of sale deeds or the conveyance deed from DDA, the sanctioned building plan, the completion certificate, mutation in MCD records, the latest property tax receipt and electricity and water bills. For a flat in a cooperative group housing society, ownership runs through membership: the share certificate, the society's NOC and the Registrar of Cooperative Societies' approval of the transfer matter as much as the deed. For a flat in a developer project in Noida, Greater Noida or Gurugram, check the RERA registration, the builder-buyer agreement, the occupancy certificate, the tripartite sub-lease or conveyance deed, and whether the builder has paid the land dues to the authority, since unpaid dues have held up registration for thousands of buyers.

Stamp duty is charged on the higher of the price and the circle rate. Delhi charges women buyers a lower rate, and joint purchases fall in between; Uttar Pradesh and Haryana have their own concessions. Registration is at the sub-registrar office for the area, with both parties and two witnesses present. After registration, mutation in the municipal or authority record should be applied for, since it governs property tax and later dealings, even though mutation is not proof of title.

Disputes tend to fall into a few groups. Against builders: delayed possession, reduced area, poor construction and missing amenities, which go to the RERA authority or the consumer commission at the buyer's choice. Between landlord and tenant: old tenancies with rent up to β‚Ή3,500 a month in Delhi are governed by the Delhi Rent Control Act 1958, where eviction for the landlord's bona fide need under section 14(1)(e) is the usual route; newer tenancies are contractual and go to the civil court or the rent authority under any new tenancy law the state has adopted. Within families: partition, wills and succession, and disputes over who may live in the house. Senior citizens can approach the Maintenance Tribunal under the Maintenance and Welfare of Parents and Senior Citizens Act 2007, which in appropriate cases has ordered children to vacate a parent's house. A wife's right to reside in the shared household under the Domestic Violence Act 2005 can also affect who stays in a property.

A few habits prevent most problems. Never buy on a GPA and agreement to sell alone. Insist on the occupancy or completion certificate. Keep original documents safe and certified copies handy. And put family arrangements about a house in writing, ideally a registered partition or family settlement, before a death or a marriage breakdown turns them into litigation.

Frequently asked questions

What is the circle rate of property?

It is the minimum value per square metre (or per hectare for farmland) that the state fixes for property in a locality. Stamp duty is charged on the circle rate value or the actual price, whichever is higher. In Delhi it is notified by the Revenue Department, in UP by the District Magistrate and in Haryana by the Deputy Commissioner.

Can I register a property below circle rate?

Yes, but you pay stamp duty on the circle rate value, not the lower price. The Income Tax Department may also treat the circle rate value as the sale price for the seller and tax the gap as income for the buyer if it exceeds the 10 per cent tolerance. Keep a valuer's report explaining the lower price.

Who pays the extra stamp duty if the circle rate is higher than the price?

The law usually puts stamp duty on the buyer for a sale deed, but parties can agree otherwise. Write the agreed position in the agreement to sell so it is not argued over at the registration counter. The tax consequences fall on each party separately and cannot be shifted by agreement.

How is circle rate calculated for a flat?

It depends on the state and district list. Delhi uses a per square metre rate for built-up area that varies with flat size, while UP district lists may price flats on covered or super area with additions for floor, facing or road width. Use the area unit the list uses and state it in the deed.

What is the circle rate for agricultural land?

Agricultural land is usually priced per hectare by village, with higher rates for land along main roads or highways. If the land has been put to non-agricultural use or declared non-agricultural, the higher rate generally applies. Check the current list for the village and tehsil.

What happens if the Sub-Registrar says my deed is undervalued?

The deed is referred to the Collector of Stamps, who issues notice, may inspect the property, hears you and fixes the value. You may have to pay the deficit duty with interest and, in some states, a penalty. A detailed reply with documents and photographs is your best defence.

Can I appeal against a Collector's stamp valuation order?

Yes. Each state's stamp law provides an appeal or revision, usually to the Chief Controlling Revenue Authority or a Commissioner, within a short period, and some require a deposit. After that, a writ petition to the High Court is possible where the order is arbitrary or passed without hearing.

Does section 50C still apply after the new Income-tax Act?

The Income-tax Act 2025 applies from tax year 2026-27 and carries the same rule forward under a new section number. The seller's capital gains can still be computed on the stamp duty value if it exceeds the price by more than 10 per cent. Ask your chartered accountant to check the current provision for your year of sale.

Is the circle rate the same as the market value?

No. The circle rate is a government minimum for stamp duty purposes. Market value can be higher or lower depending on condition, location within the locality, litigation and demand. Banks, tax officers and courts may each look at market value separately.

Do DDA or Noida transfer charges depend on the circle rate?

Usually not. Authorities such as DDA, Noida, Greater Noida and GDA calculate transfer and conversion charges on their own notified rates. Stamp duty on the transfer deed still follows the circle rate, so budget for both.

How do I object to a wrong circle rate for my area?

Watch for the draft list that many districts publish before revision, and file a written objection with evidence of actual sale prices. Once the list is final, the Collector can sometimes treat a specific property differently on its facts. A challenge to the whole notification goes to the High Court by writ.

Does a gift deed to a family member attract circle rate valuation?

The deed is still valued, but several states charge a concessional or fixed stamp duty on gifts to close relatives, so the circle rate matters less for duty. Gifts to relatives are not taxed as income of the recipient. The value still matters for the recipient's future capital gains.

Should I go to RERA or the consumer commission against my builder?

You can choose either, as the Supreme Court held in Newtech Promoters v State of UP (2021), but not both for the same relief. RERA is often quicker for refund or delay interest under section 18; the consumer commission can also award compensation for deficiency in service. The choice depends on the amount, the relief you want and how far the project has progressed.

Can my son be evicted from my house if he harasses me?

In many cases, yes. The Maintenance Tribunal under the Senior Citizens Act 2007 has power to protect a parent's property and life, and courts have upheld eviction orders against children in suitable cases. The parent's ownership of the house and evidence of ill-treatment are the key facts.
