Stamp Duty Advisory For Residential Property raises a familiar set of questions: who has to sign, what has to be checked, where the matter is decided and what it will involve. This page answers them. The firm of Advocate B.K. Singh handles this work from offices in Dwarka, New Delhi and Vaishali, Ghaziabad.
In short. Stamp duty is a state tax on the document, not on the property. The rate depends on what the document is (sale, gift, lease, mortgage, partition, power of attorney), the state, the buyer and the higher of the price and the circle rate value. Stamp duty advisory means classifying the document correctly before it is signed, paying the right duty and answering any undervaluation notice.
Most people meet stamp duty at the last minute: the deal is agreed, the e-stamp has to be bought, and someone at the Sub-Registrar office announces a figure. That is the wrong time to find out that the document has been drafted as a sale when it could lawfully have been a gift to a family member, that a power of attorney for consideration is charged like a conveyance, or that the circle rate for the plot is higher than the price everyone agreed. Stamp duty is charged on the instrument, so the words of the document decide the tax. Changing the words after execution rarely helps.
This page explains how stamp duty works on property documents in Delhi, Uttar Pradesh (including Noida, Greater Noida and Ghaziabad) and Haryana: the law, how duty is worked out for each kind of document, lawful concessions, under-stamped documents, section 47A notices, refunds, and how the advice changes by property type and by party. It does not quote every state's current rate, because rates change by notification; it tells you where to look and what to ask.

What stamp duty is and why the document matters more than the deal
Stamp duty is a tax on instruments, that is, on written documents that create, transfer, limit, extend or record a right. Section 3 of the Indian Stamp Act 1899 makes every instrument listed in Schedule I chargeable, and the states have their own schedules and rates. The tax is triggered by the document, so two transactions with the same economic result can carry very different duty depending on how they are written. A father who wants his daughter to own his flat can sign a gift deed, a sale deed, a release deed if she is already a co-owner, or a will; each is charged differently and some are not charged at all.
That is why stamp duty advisory starts with the question "what is this document, legally?" and not "what is the rate?". Sub-Registrars and Collectors look at the substance of the instrument, not its title. A document called an "agreement" that hands over possession and receives the full price may be treated as a conveyance. A "power of attorney" given for money and authorising sale is charged like a sale in Delhi and UP. A "family settlement" that actually transfers shares for the first time can be treated as a partition or a release. Getting the classification right is most of the work.
Stamp duty is separate from the registration fee charged under the Registration Act 1908, and separate from income tax and GST, though people often lump them into one "registry charge". Each has a different legal basis and a different way to dispute it. Our page on registration fee advisory covers the second charge.
The legal provisions behind stamp duty on property documents
Sections 3, 17 and 18, Indian Stamp Act 1899
Section 3 charges duty on the instruments listed in the Schedule. Section 17 requires instruments executed in India to be stamped before or at the time of execution, which is why the e-stamp certificate must be dated on or before the signing date. Section 18 gives 3 months from first receipt in India for instruments signed abroad, which matters for NRIs signing powers of attorney or deeds at an Indian mission or before a foreign notary.
Sections 31 and 32, Indian Stamp Act 1899 (adjudication)
Any person can bring an executed or unexecuted instrument to the Collector of Stamps and ask for an opinion on the duty payable. Once the duty assessed is paid, the Collector certifies it by endorsement under section 32, and the instrument is then treated as duly stamped. Adjudication is under-used and is the safest route for unusual documents such as development agreements, family arrangements and corporate transfers.
Sections 33, 35, 38 and 40, Indian Stamp Act 1899 (impounding and penalty)
A court, public office or authority before which an under-stamped instrument is produced must impound it (section 33). Section 35 makes an unstamped or under-stamped instrument inadmissible in evidence unless the deficit and a penalty, which can go up to ten times the deficit, are paid. Impounded instruments go to the Collector, who can recover the duty and penalty and has some discretion over the penalty under section 40.
Section 47A, as applied in Delhi and as amended in UP
Where the Sub-Registrar believes the market value or consideration has not been truly set out, the instrument is referred to the Collector, who decides the market value and the duty after hearing the parties. Delhi works this through the Delhi Stamp (Prevention of Undervaluation of Instruments) Rules 2007, which also govern the circle rates. UP's version allows the Collector to act on reference or on his own motion, adds penalty and interest on the deficit, and provides an appeal; check the current state provision for limits and timelines.
Schedule I articles commonly used in property work
Conveyance (Article 23), gift (Article 33), lease (Article 35), mortgage (Article 40), agreement relating to deposit of title deeds (Article 6), exchange (Article 31), partition (Article 45), power of attorney (Article 48), release (Article 55), settlement (Article 58) and transfer of lease (Article 63). States have amended many of these articles and their rates, so always read the article as it stands in the state where the property is.
How duty is usually worked out for common property documents
| Document | What the duty is usually based on | Points that change the answer |
|---|---|---|
| Sale deed or conveyance | Higher of the price and the market value under the circle rate | State, buyer's gender in Delhi, UP and Haryana, built-up area, floor, use (residential, commercial, industrial), road width or locality category |
| Gift deed | Market value of the property | Some states give flat or reduced duty for gifts to close family members; the list of relatives and property types covered is set by notification |
| Release or relinquishment deed | Value of the share released | Many states charge lower duty where the release is between co-heirs or family members; a release to an outsider is treated like a sale |
| Partition deed | Value of the separated shares, with the largest share treated as the one from which others are separated | Whether the property is already jointly held; partition decrees and deeds are charged differently from fresh transfers |
| Exchange deed | Value of the property of greater value | Each property's circle rate; who pays is equal by default |
| Lease deed | Average annual rent, term of the lease, premium and security deposit in some states | Long leases are charged close to a conveyance; lock-in and renewal clauses can change the term counted |
| Mortgage deed or memorandum of deposit of title deeds | Amount secured | Mortgage with possession is charged like a conveyance; equitable mortgages by deposit of title deeds have their own article and caps in some states |
| Power of attorney | Fixed duty for a general or special power | A power for consideration that authorises sale of immovable property is charged like a conveyance in Delhi and UP |
| Agreement to sell | Usually a small or moderate duty | In UP and several other states, an agreement with delivery of possession is charged as a conveyance |
Circle rate, market value and the price you agreed
For conveyances, gifts, exchanges and similar documents, duty is charged on the higher of the stated consideration and the market value worked out from the circle rate. Delhi's circle rates are notified by the Revenue Department of the Delhi Government, with localities grouped into categories. In UP, the District Magistrate of each district, including Gautam Buddh Nagar and Ghaziabad, notifies the rate list. Haryana calls them collector rates and they are fixed district by district. The rates carry separate figures for land and construction, and adjustments for use, floor, corner plots or main road frontage.
Paying duty on the circle rate value when the real price is higher is evasion, not planning. Section 27 requires the true consideration to be stated, and a buyer who later shows a higher price to a bank or the income tax department has created evidence against himself. The reverse problem, a genuine price below the circle rate, is common for old buildings, disputed properties and distressed sales. Duty is still charged on the circle rate value, and the income tax law treats the circle rate value as the sale consideration for the seller and taxes the difference in the buyer's hands if it exceeds the tolerance band (the old sections 50C and 56(2)(x), now carried into the Income-tax Act 2025). Our circle rate advisory page covers how to challenge an unfair valuation.
The area figure is where most disputes start. Circle rates for flats in Delhi are often applied to the covered or built-up area, while the builder's agreement speaks of super area. For plots and houses, land and construction are valued separately, and the age of the building may reduce the construction value under the state's rules. A wrong area figure in the deed, even by accident, invites a section 47A reference. When Advocate B.K. Singh checks a sale deed draft before stamping, the first thing he compares is the area in the deed against the sanctioned plan, the property tax record and the previous registered deed, because a mismatch between those three is what the Sub-Registrar notices first.
Concessions that are lawful, and planning that is not
The lawful ways to reduce stamp duty are written into the state notifications, and they are worth knowing before you draft. Delhi, UP and Haryana all charge women buyers less than men on conveyances, though the size of the concession and any value cap differ; in Delhi the rate for joint ownership by a man and a woman sits between the two. Several states charge flat or reduced duty on gifts and releases between close family members. Partition among co-owners is charged far less than a sale. A will attracts no stamp duty at all, and property that passes by inheritance needs no stamped transfer document, only mutation in the records.
Each concession comes with conditions. The family member concession usually covers a defined list of relatives, and some notifications are limited to residential or agricultural property or to property within the state. A woman's concession can be lost if the property is transferred again within a short period or if she is a name-lender for a male relative who paid. A partition deed is charged as a partition only if the property was already held jointly; using a partition deed to bring in an outsider is a transfer. Reading the current notification, not last year's WhatsApp forward, is the only safe course.
What does not work is splitting one deal into an under-valued sale deed plus a separate "cash" receipt, registering a sale as a gift when money changes hands, or executing an unregistered agreement and power of attorney instead of a sale deed. The Supreme Court in Suraj Lamp v State of Haryana (2011) made it clear that GPA sales and agreements do not convey title, and Delhi and UP now charge most such powers like a conveyance anyway. The money saved on duty is usually lost later in penalty, a defective title or a failed bank loan.
How stamp duty advisory works, step by step
A typical engagement follows the same sequence whether the document is a sale deed for a flat or a lease of a warehouse.
Understand the transaction
We start with what the parties actually want to achieve: transfer ownership, share it, secure a loan, let the property or settle a family arrangement. The relationship between the parties, the money involved and the timing all affect which document fits. Sometimes the answer is a different document altogether.
Check title and property details
Stamp duty depends on facts in the title papers: the area, the use, whether the land is freehold or leasehold, whether it is agricultural, and who the current owners are. A quick title verification often reveals that the seller's share or the property description is not what everyone assumed.
Classify the instrument
We decide which Schedule I article applies under the state law and whether any concession or exemption is available. Where the document is unusual, such as a joint development agreement, a family settlement or a corporate transfer, we consider asking the Collector for adjudication under section 31 before execution.
Compute duty and fees
We work out the market value from the current circle rate list, compare it with the agreed price and calculate stamp duty, registration fee and any other levy. The figures are shared in writing with the basis for each, so the parties can check them against the Sub-Registrar's own calculation.
Draft the deed to match
The deed must state the consideration, the area, the property description and the facts that justify any concession. Recitals about relationship, earlier co-ownership or inheritance should be supported by documents annexed or produced at registration.
Buy the e-stamp and register
The e-stamp is bought in the name of the party paying, for the correct article and amount, dated on or before execution. We then book the registration slot and check the documents the Sub-Registrar will ask for. Our e-stamp assistance page explains the purchase process.
Follow up after registration
Keep the registered deed, the e-stamp certificate and the receipt together. Apply for mutation with the municipal body, development authority or revenue office promptly, and respond at once if a section 47A notice arrives later.
Stamp duty on sale deeds, gift deeds and family transfers
On a sale deed, the buyer pays unless the agreement says otherwise, and the duty is the state rate applied to the higher of price and circle rate value. Joint purchases need care: if a husband and wife buy together in Delhi, the rate depends on how the ownership is recorded, and adding a co-owner later by a separate deed costs more than getting the names right the first time. Our sale deed drafting page covers the clauses that matter for duty.
A gift deed is charged on market value, but the states treat family gifts generously in different ways. UP has notified a flat, low duty for gift deeds of property to specified family members, and Haryana has long exempted certain gifts between blood relations; both have conditions and lists of relatives that change by notification. Delhi's treatment of family gifts is different again. A gift deed must be registered under section 123 of the Transfer of Property Act and accepted by the donee during the donor's lifetime. See gift deed drafting for the drafting side.
Within families, a release or relinquishment deed is often the right tool where heirs already co-own inherited property and one of them wants to give up his share in favour of the others. Duty on a release between co-heirs is usually lower than on a gift or sale, but a release cannot be used by someone who does not yet own a share. A family settlement that only records an earlier oral arrangement may not need stamping or registration at all, while one that itself divides or transfers property does. Our pages on relinquishment deed drafting and family settlement deeds explain when each fits.
Stamp duty on leases, mortgages and powers of attorney
Lease duty depends on the term and the rent, and on any premium, advance or deposit the state counts. A lease for a long term, such as 30 years or more, is charged close to a conveyance, while a short residential lease attracts a modest amount. Leases for more than one year must be registered under section 17 of the Registration Act, and an unregistered lease cannot be used to prove its terms beyond what section 49 allows. Commercial tenants often sign an 11-month agreement to avoid registration and duty, which saves little and leaves them with weak protection. Our lease deed drafting page explains the choice.
Mortgage documents are charged on the amount secured. A registered mortgage deed and an equitable mortgage by deposit of title deeds fall under different articles, and some states cap the duty on loan security documents. For banks and NBFCs the question is enforceability: an under-stamped mortgage deed or memorandum of deposit can be impounded when it is produced before the DRT or a civil court, and the lender then pays the deficit and penalty before relying on it. Our page on mortgage deed drafting covers the security side.
Powers of attorney are charged at a small fixed rate when they are true agency documents. Where the power is given for consideration and authorises the attorney to sell immovable property, Delhi and UP charge it like a conveyance on market value. That rule was aimed at GPA sales. A power of attorney executed abroad must be stamped within 3 months of its first receipt in India, usually by presenting it to the Collector of Stamps for adjudication, before it is used at the Sub-Registrar or with an authority.
If a document was under-stamped or not stamped at all
An under-stamped document is not void, but it is a problem waiting to surface. Under section 35 it cannot be admitted in evidence until the deficit and penalty are paid, and any public office before which it is produced must impound it. The penalty in court can go up to ten times the deficit. The Collector, when the instrument comes to him, can recover the duty with a penalty and has some discretion to reduce the penalty, especially where the party comes forward voluntarily.
The practical advice is to regularise before you need the document. If you hold an old agreement, a lease or a family arrangement that was stamped on the wrong article, take it to the Collector under section 31 or the relevant voluntary payment provision, pay the deficit and get the endorsement. Doing this before a suit is filed or a bank loan is sought is cheaper and calmer than doing it when the other side has objected to admissibility. Once a court admits a document in evidence, section 36 generally bars the objection being raised again later in the same suit.
Deliberate evasion is a different matter. Section 64 makes it an offence to leave out facts affecting duty with intent to defraud the government, and a hidden cash component now also exposes both sides to income tax trouble. We do not advise on structuring deals to hide consideration.
Answering a section 47A notice for undervaluation
A section 47A notice says the Collector believes the market value in your registered deed is too low and proposes extra duty, often with penalty and interest in UP. It is not a final order. You have the right to see the basis of the proposed value, to file a written reply, to produce evidence and to be heard. Many notices are issued on a site inspection report that applies the wrong category, the wrong use or the wrong area, and those errors can be corrected.
A good reply sets out the facts the inspector missed: the actual use (a residential building used partly for a shop is not automatically commercial), the sanctioned area against the area measured, the age of the construction, the road width, whether the land is within or outside a notified abadi, and any encumbrance that depresses value. Attach the sanctioned plan, the property tax assessment, photographs, the previous registered deed and, where helpful, a report from a registered valuer. Ask for a copy of the inspection report and the comparable sales relied on if they are not attached.
If the Collector's order still goes against you, the state law provides an appeal or revision, usually to the Commissioner or the Chief Controlling Revenue Authority, within a short limit. In UP, pay attention to the interest that keeps running on the deficit. A writ to the High Court is for orders passed without hearing, on no evidence or in breach of the statute, not for re-arguing the valuation. In the section 47A cases that come to Advocate B.K. Singh's office, the reply usually turns on one or two facts that were never put to the inspector, so collecting those facts quickly matters more than legal argument.
Refunds of e-stamps and spoiled stamps
If an e-stamp was bought for a deal that fell through, or a deed was spoiled before or after signing, the Stamp Act allows an allowance or refund for spoiled and unused stamps, less a deduction. The application goes to the Collector of Stamps with the original e-stamp certificate, an affidavit explaining what happened and proof that the instrument was not used or registered. The deadlines are short, commonly six months from the date of the stamp or the instrument, and the states have tweaked them, so apply as soon as you know the deal is off.
How the answer changes by property type
For a flat in a group housing society or a builder floor, duty usually turns on the built-up or covered area, the floor and whether parking and common areas are separately valued. Flats bought from a developer are conveyed by a conveyance deed after completion, and the circle rate at the date of that deed applies, not the rate when the flat was booked.
For shops, offices, warehouses, industrial sheds and resort property, commercial or industrial circle rates apply and are much higher than residential ones. Industrial plots in Noida, Greater Noida and the Haryana estates are leasehold, so the transfer is a transfer of lease, sublease or assignment, and the authority's own transfer charges are payable in addition to duty. A farmhouse may be valued as agricultural land plus construction or as residential property, depending on the land's recorded use and any conversion.
For agricultural land, the circle rate is set per hectare or per bigha, often with higher rates for land along main roads, and land within a notified urban area may be valued at urban rates. Inherited property needs no stamp duty on inheritance itself; duty arises only when the heirs later partition, release, gift or sell. For cooperative society property in Delhi, the transfer of a share and flat follows the society's bye-laws and the conveyance by the society, and the duty depends on whether the flat has been conveyed to members on freehold terms. For leasehold DDA or L&DO property, conversion to freehold involves its own conveyance deed on which duty is charged.
How the answer changes by party
A bank or NBFC asks stamp duty questions about security documents: whether the loan agreement, guarantee, mortgage deed and memorandum of deposit are stamped correctly in the state where they were executed and where the property sits. Stamp duty is also a red flag in title search reports for lenders, because an under-stamped link in the chain can delay enforcement. A company or LLP faces duty on property transfers, on leases of offices and plants, and on court-sanctioned amalgamations and demergers, which several states treat as conveyances. Issue and transfer of shares through depositories are now stamped at uniform central rates collected through the depositories, which is a separate regime from property documents.
An NRI usually executes a power of attorney abroad, gets it stamped in India within 3 months of receipt and uses it for the sale or purchase. If the NRI is buying, check that the payment comes through banking channels and that the deed records it. A senior citizen transferring property to children should compare a gift, a release and a will, and should consider keeping a life interest or a right of residence; the Maintenance and Welfare of Parents and Senior Citizens Act 2007 allows a transfer conditioned on care to be declared void if the condition is breached.
Delhi, Noida, Ghaziabad and Gurugram: practical differences
In Delhi, duty is paid by e-stamp, documents are registered at the district Sub-Registrar through an online appointment, and the circle rate comes from the Revenue Department's category list; leasehold DDA and L&DO property often needs conversion or permission before transfer. In Noida, Greater Noida and Ghaziabad, the UP rate and the district rate list apply, deficits carry interest and penalty, and authority-allotted property needs the authority's transfer documents and charges. In Gurugram and the rest of Haryana, collector rates apply and rates differ between urban and rural areas and between men and women. For any transaction, the law of the state where the property is situated governs, and rates are changed by notification without fanfare, so check the current one before buying the e-stamp.
Common stamp duty mistakes
- E-stamp dated after the signing. Section 17 requires stamping before or at execution. Stamps bought after the deed was signed invite questions and, in some offices, a penalty.
- Wrong article. A gift drafted as a sale, a sale drafted as a release, or a lease drafted as a licence attracts the wrong duty and can be impounded later.
- Wrong area or use. Using super area where the rule needs covered area, or describing a mixed-use building as purely residential, is the commonest trigger for a section 47A notice.
- Claiming a concession without proof. A woman's or family concession needs documents: relationship proof, the earlier title showing co-ownership, or an affidavit as the notification requires.
- Leaving a foreign power of attorney unstamped. The 3-month window under section 18 is often missed, and the Sub-Registrar will refuse to act on the document.
A made-up example: a mother's flat and three children
Here's a made-up example. A widow owns a flat in Ghaziabad bought in her own name. She wants her daughter to have it, and her two sons agree. The family first plans a sale deed from the mother to the daughter at a nominal price, which would attract full duty on the circle rate value and a capital gains question for the mother.
On review, three options emerge. The mother can gift the flat to her daughter, and the UP notification for family gifts may apply if the relationship and property type are covered. She can make a registered will, which costs no duty now but leaves the flat in her name until her death. Or, if she prefers, the property can pass on her death and the sons can then release their shares to the daughter by a release deed. The family chooses a gift deed with a clause reserving the mother's right to live in the flat. The duty is a fraction of the sale deed figure, the deed is registered and the daughter applies for mutation with the municipal body.

- Power of attorney, with stamping and attestation details if executed abroad
- Death certificate and succession papers for inherited property
Transaction papers
- Draft deed or term sheet
- Agreement to sell or allotment letter, with payment receipts
- Current circle rate list for the locality
- Any section 47A notice, inspection report and earlier replies
- Original e-stamp certificate and proof of non-use, for refunds
Cost and time in general terms
Stamp duty and registration fee are government charges paid by e-stamp or online challan; they are not part of any lawyer's fee. Professional fees are discussed at the first meeting and agreed in writing, and valuer reports and certified copies are separate costs. A straightforward calculation and drafting check takes a few days once the papers are in hand; adjudication, refunds and section 47A proceedings depend on the Collector's listing and can take weeks or months.
What to do this week
- Write down in one line what the transaction is meant to achieve and who is paying whom.
- Collect the current title deed, the sanctioned plan and the property tax record, and check that the area figures match.
- Download the current circle rate list for the locality and note the category, use and floor figures that apply.
- Check whether a women's, family or partition concession could lawfully apply, and what proof it needs.
- Do not buy the e-stamp until the deed is finalised and the article is confirmed.
- If you have received a section 47A notice, note the reply date and ask for the inspection report.
- If an e-stamp is lying unused, apply for the refund now before the period runs out.
When to get the papers checked
Stamp duty problems are cheapest to fix before execution and most expensive after a court or the Collector has impounded the document. If the transaction is between family members, involves leasehold or agricultural land, crosses state lines, involves a company or a foreign power of attorney, or the price is below the circle rate, have the draft reviewed before stamping. Also check the Sub-Registrar appointment process and plan mutation straight after registration.
If you want the papers checked before you act, the team of Advocate B.K. Singh at Legals365 can review them and tell you the next step through talk to a lawyer.
Residential property: what changes
Residential property covers houses, builder floors, flats in group housing societies and apartments in developer projects. It is the property people care about most, and the law gives it more protection than commercial premises: consumer remedies against builders, rent control for old tenancies, special rules for senior citizens and family members. It also carries more family disputes than any other kind of asset.
The documents depend on the type. For an independent house or builder floor in Delhi, ask for the chain of sale deeds or the conveyance deed from DDA, the sanctioned building plan, the completion certificate, mutation in MCD records, the latest property tax receipt and electricity and water bills. For a flat in a cooperative group housing society, ownership runs through membership: the share certificate, the society's NOC and the Registrar of Cooperative Societies' approval of the transfer matter as much as the deed. For a flat in a developer project in Noida, Greater Noida or Gurugram, check the RERA registration, the builder-buyer agreement, the occupancy certificate, the tripartite sub-lease or conveyance deed, and whether the builder has paid the land dues to the authority, since unpaid dues have held up registration for thousands of buyers.
Stamp duty is charged on the higher of the price and the circle rate. Delhi charges women buyers a lower rate, and joint purchases fall in between; Uttar Pradesh and Haryana have their own concessions. Registration is at the sub-registrar office for the area, with both parties and two witnesses present. After registration, mutation in the municipal or authority record should be applied for, since it governs property tax and later dealings, even though mutation is not proof of title.
Disputes tend to fall into a few groups. Against builders: delayed possession, reduced area, poor construction and missing amenities, which go to the RERA authority or the consumer commission at the buyer's choice. Between landlord and tenant: old tenancies with rent up to ₹3,500 a month in Delhi are governed by the Delhi Rent Control Act 1958, where eviction for the landlord's bona fide need under section 14(1)(e) is the usual route; newer tenancies are contractual and go to the civil court or the rent authority under any new tenancy law the state has adopted. Within families: partition, wills and succession, and disputes over who may live in the house. Senior citizens can approach the Maintenance Tribunal under the Maintenance and Welfare of Parents and Senior Citizens Act 2007, which in appropriate cases has ordered children to vacate a parent's house. A wife's right to reside in the shared household under the Domestic Violence Act 2005 can also affect who stays in a property.
A few habits prevent most problems. Never buy on a GPA and agreement to sell alone. Insist on the occupancy or completion certificate. Keep original documents safe and certified copies handy. And put family arrangements about a house in writing, ideally a registered partition or family settlement, before a death or a marriage breakdown turns them into litigation.
Frequently asked questions
Who pays stamp duty on a sale deed, buyer or seller?
The buyer pays stamp duty on a sale deed unless the parties agree otherwise in writing, under section 29 of the Indian Stamp Act. The agreement to sell should say clearly who bears duty and registration fee. If it is silent and the deal goes ahead, the Sub-Registrar will expect the buyer's e-stamp.
Is stamp duty charged on the circle rate or the actual price?
On the higher of the two. If the real price is above the circle rate, duty is charged on the real price, and the deed must state it truly. If the price is below the circle rate, duty is still charged on the circle rate value.
Can stamp duty be paid after signing the deed?
Section 17 requires stamping before or at the time of execution, so the e-stamp should be dated on or before the signing date. A document stamped later is treated as under-stamped and can attract penalty. Documents signed abroad get 3 months from first receipt in India.
Is there stamp duty on inherited property?
No stamp duty is payable on property received by inheritance or under a will; the heirs apply for mutation with a death certificate and succession papers. Duty arises only when heirs later sign a partition deed, release deed, gift deed or sale deed. The duty then depends on the document and the state.
Do women pay less stamp duty in Delhi and UP?
Yes, Delhi, UP and Haryana all charge women buyers a lower rate on conveyances, but the size of the concession and any value limits differ by state. Joint ownership with a man may attract an intermediate rate. Check the current notification before buying the e-stamp.
What happens if my document is under-stamped?
It cannot be used as evidence until the deficit and penalty are paid, and an authority or court before which it is produced must impound it. The penalty in court can reach ten times the deficit. Paying the deficit voluntarily before a dispute arises is usually cheaper.
How do I reply to a section 47A stamp duty notice?
Ask for the inspection report and the basis of valuation, then file a written reply with the sanctioned plan, tax records, photographs and any valuer's report showing the correct area, use and category. Attend the hearing. If the order is still wrong, file the appeal or revision allowed by the state law within time.
Can I get a refund of an unused e-stamp?
