If you are dealing with rent agreement drafting for a residential property, this guide sets out the legal position, the documents you will need, the usual steps and the mistakes that cost people time. The firm of Advocate B.K. Singh handles this work from offices in Dwarka, New Delhi and Vaishali, Ghaziabad.
In short. A rent agreement is a lease of property for rent, governed by the Transfer of Property Act 1882 and the state rent law. A sound draft names the parties and property, the term, rent, escalation, deposit, maintenance, repairs, use, subletting, lock-in, notice and handover. A tenancy for more than a year must be stamped and registered; shorter ones still need proper stamp duty.
A rent agreement is usually signed in a hurry, on the day the keys change hands, from a format someone downloaded or the broker brought along. It is then filed away and forgotten. It matters only when something goes wrong: the tenant stops paying, the landlord wants the property back before the term ends, the deposit is not refunded, the tenant has sublet a room, or a pipe bursts and nobody agrees who should pay. On that day the agreement either answers the question in a line or starts a dispute.
This page explains how a rent agreement is drafted in Delhi, Uttar Pradesh and Haryana: the law behind it, the clauses that matter, the eleven-month practice and its limits, stamp duty and registration, the Uttar Pradesh Regulation of Urban Premises Tenancy Act 2021, and how the draft changes for a flat, shop, godown, farmhouse, resort or industrial shed, and for landlords and tenants such as banks, companies, startups, NRIs and investors. It is written for both sides of the table.
- Law
- Transfer of Property Act 1882 (ss.105 to 117), Registration Act 1908 (s.17(1)(d), s.49), Indian Stamp Act 1899 as applicable in the state (lease article), Delhi Rent Control Act 1958, UP Regulation of Urban Premises Tenancy Act 2021, Haryana Urban (Control of Rent and Eviction) Act 1973, Indian Contract Act 1872
- Forum
- No forum is needed to draft; the agreement is stamped on e-stamp paper and, if required, registered at the Sub-Registrar; in Uttar Pradesh it must also be reported to the Rent Authority
- Time limit
- Stamp duty is paid before or at signing; a registrable agreement must be presented within four months of execution; in Uttar Pradesh the tenancy must be reported to the Rent Authority within the period the 2021 Act fixes
- Documents
- Owner's title document or allotment, latest tax and electricity bills, identity and address proof of both sides, tenant's police verification form, society or authority NOC where needed, board resolution for a company
- Registration
- Compulsory for a lease from year to year, for more than one year, or reserving a yearly rent; optional but advisable for shorter terms
What a rent agreement is and what it has to do
A rent agreement is a lease: a transfer of the right to use immovable property for a period in return for rent. Section 105 of the Transfer of Property Act 1882 defines a lease, and sections 106 to 117 set the rules that apply when the agreement is silent. The everyday phrase rent agreement usually describes a short residential or small commercial tenancy, while lease deed is used for longer and larger lettings, but the law treats both the same way. If you are letting for many years, read our page on lease deed drafting as well.
A good rent agreement does four jobs. It records exactly what is let and to whom. It fixes the money: rent, increases, deposit, maintenance and utilities. It sets the rules of use: residential or commercial, subletting, alterations, guests, society rules. And it decides how the tenancy ends: term, lock-in, notice, handover, deposit refund and what happens if the tenant does not leave. Most disputes come from the fourth job, which most downloaded formats handle in two vague lines.
Both landlords and tenants benefit from careful drafting. A landlord wants a clear exit and a deposit that covers damage. A tenant wants protection against arbitrary increases, a fair repair clause, and an assurance that the deposit will come back. These interests are not opposed as often as people think; a precise agreement usually serves both.
Rent agreement, lease deed or leave and licence: which one you need
The title on the paper does not decide what it is; the substance does. A tenancy gives exclusive possession and an interest in the property. A licence under section 52 of the Indian Easements Act 1882 gives only permission to use, with the owner keeping control. Courts look at exclusive possession, who holds the keys, the purpose and the intention of the parties. A paying guest arrangement, a seat in a shared office, a kiosk in a mall or a room in a house where the owner lives can be a licence. A whole flat or shop handed over with keys is almost always a tenancy.
Some owners draft a tenancy as a leave and licence agreement to stay outside rent control or to pay less stamp duty. If the facts show a tenancy, a court will treat it as one, and the owner is left with a document that does not do what he wanted. Choose the form that matches the arrangement.
For terms above a year, or where large sums or major alterations are involved, a registered lease deed is the right document. For short residential lettings, a well-drafted rent agreement on proper stamp paper is usually enough, so long as the parties understand its limits.
The law behind a rent agreement
Sections 105 to 108 and 116, Transfer of Property Act 1882
Section 106 supplies the default duration and notice: unless the contract says otherwise, a lease for residential or commercial purposes is month to month and ends on fifteen days' notice, while a lease for agricultural or manufacturing purposes is year to year and ends on six months' notice. Section 107 requires a lease from year to year, for more than a year, or reserving a yearly rent, to be made by a registered instrument. Section 108 lists the default rights and duties of both sides. Section 116 says that a tenant who stays on after the term with the landlord's assent, for example by the landlord accepting rent, is treated as holding a renewed tenancy on the default terms.
Section 17(1)(d) and section 49, Registration Act 1908
Leases from year to year, for a term exceeding one year, or reserving a yearly rent must be registered. An unregistered agreement that needed registration does not create the lease it describes, though it may be used for collateral purposes such as proving the nature of possession.
State rent laws
The Delhi Rent Control Act 1958 does not apply to premises let at a monthly rent above Rs 3,500 (section 3(c)), so most present-day Delhi tenancies are governed by the agreement and the Transfer of Property Act. The Uttar Pradesh Regulation of Urban Premises Tenancy Act 2021 applies to urban premises in UP, including Noida, Greater Noida and Ghaziabad, requires a written agreement and reporting to the Rent Authority, and caps the security deposit. Haryana's Urban (Control of Rent and Eviction) Act 1973 governs controlled tenancies there.
Indian Stamp Act 1899 and state stamp laws
Every lease, including a short rent agreement, attracts stamp duty under the lease article of the state's stamp schedule, usually calculated on the average annual rent and any premium, and in some states on deposits or advances as well. An under-stamped agreement can be impounded when produced in court and admitted only after the deficit and a penalty are paid.
The eleven-month rent agreement: what it does and what it does not
The eleven-month agreement exists because a lease for less than a year does not need compulsory registration under section 107 of the Transfer of Property Act and section 17 of the Registration Act. It saves a visit to the Sub-Registrar and some stamp duty. For an ordinary flat let to a family, renewed every year, it works well enough. It is a choice with limits, not a device that makes every risk disappear.
The first limit is that an eleven-month agreement gives neither side security beyond eleven months. A tenant who has spent money fitting out a shop has no assurance of renewal, and a landlord who wanted a three-year lock-in cannot enforce one through repeated eleven-month papers as reliably as through a registered lease. The second limit is stamp duty: an eleven-month agreement still has to be stamped at the rate for a lease of that term, and a notarised agreement on a low-value stamp paper is not properly stamped just because a notary has signed it. Notarisation only attests signatures; it does not replace stamp duty or registration.
The third limit concerns holding over. When the eleven months expire and the tenant continues paying and the landlord continues accepting, section 116 treats the tenancy as renewed month to month. The landlord then has to end it by notice before seeking eviction. Draft the agreement so that the end of term, renewal, and the effect of staying on are spelt out, and keep renewals in writing.
Which rent agreement needs what
| Arrangement | Registration | Stamp duty | Practical note |
|---|---|---|---|
| Residential, up to 11 months | Not compulsory | Yes, at the lease rate for the term | Renew in writing; check UP reporting if in Noida or Ghaziabad |
| Residential, more than 1 year | Compulsory | Yes, higher rate for longer terms | Unregistered deed cannot prove the longer term |
| Shop or office, with lock-in | Compulsory if term exceeds 1 year | Yes | Lock-in is enforceable only within a valid lease |
| Godown or industrial shed | Usually compulsory | Yes | Check industrial authority permission to let |
| Paying guest or shared seat | Usually not a lease | Licence rate, if any | Draft as a licence only if the owner keeps control |
| Bank branch or ATM site | Compulsory for long terms | Yes | Bank will use its own format; negotiate the exit and renewal clauses |
The money clauses: rent, increase, deposit and charges
State the rent as a monthly figure, the due date, the mode of payment and the bank account. Ask for payment by bank transfer rather than cash, because a bank trail is the best evidence when either side later disputes what was paid. If rent is payable in advance, say so. Add a clause on interest or a late fee for delay only if it is reasonable; an oppressive penalty may not be enforced.
Escalation should be precise: a percentage, from which date, how often. Avoid phrases such as as per market rate unless you also set out how the market rate is fixed. In Uttar Pradesh, the 2021 Tenancy Act provides for annual revision of rent at 5 percent for residential and 7 percent for non-residential premises where the agreement does not provide otherwise; check the current text before relying on it. In Delhi, for tenancies outside rent control, the agreement alone decides.
The security deposit clause should state the amount, that it carries no interest unless agreed, when it is refunded, what may be deducted (unpaid rent, unpaid bills, damage beyond normal wear and tear), and the time for refund after handover. In Uttar Pradesh the deposit cannot exceed two months' rent for residential premises and six months' rent for non-residential premises. Elsewhere the market decides, but an excessive deposit can raise stamp duty questions in states that add deposits to the value.
Spell out who pays maintenance charges to the society or RWA, electricity and water bills, property tax, common area charges, and the cost of minor and major repairs. Specify the sub-meter or the meter reading on the date of handover. Unpaid electricity bills on a property are a common source of deposit disputes.
The use and exit clauses: what most formats get wrong
Fix the permitted use. A flat let for residence should not be used as an office or guest house, and a shop let for a garment store should not become a restaurant without consent, because the change may breach municipal, fire or society rules for which the owner can also be held responsible. Prohibit subletting, assignment or parting with possession without written consent, and say whether family members, employees or group companies may occupy.
Alterations need their own clause: what the tenant may do without consent (furniture, curtains, appliances), what needs written consent (partitions, plumbing, signage), and whether the tenant must restore the premises at the end. Give the landlord a right of inspection on reasonable notice. Attach an inventory of fittings and furniture with photographs, signed by both.
The exit clause should cover the lock-in period, the notice each side must give after the lock-in, what happens if the tenant leaves during the lock-in (usually rent for the balance of the lock-in), the condition in which the premises must be handed back, the joint inspection, the return of keys and the deposit refund. Add a holding-over clause: if the tenant stays after termination, he pays a higher charge for use and occupation, without this creating a new tenancy. Courts do not always enforce such clauses in full, but they set the expectation and support a later claim for mesne profits.
When Advocate B.K. Singh drafts a rent agreement for a landlord, the clause he spends most time on is termination, because that is the clause that will be read in court. For a tenant, he looks first at the repair clause and the deposit refund clause, because those are the ones that cost tenants money.
How a rent agreement is prepared, stamped and registered
A simple residential agreement can be finalised within a day or two. A commercial or long-term agreement may take one or two weeks of negotiation.
Check the landlord's right to let
Ask for the title document, allotment or conveyance, and check that the person signing is the owner or holds a valid power of attorney. For inherited property, all co-owners should sign or authorise one of them. For mortgaged property, check whether the loan terms require the lender's consent.
Agree the commercial terms in writing
Settle rent, increase, deposit, term, lock-in, notice, maintenance and fit-out period in a short term sheet or email before drafting. It avoids redrafting at the last minute.
Draft and exchange
Prepare the draft with an inventory and the property schedule. Each side reads it fully. Make changes in writing, not by side assurances.
Pay stamp duty
Buy e-stamp paper for the correct duty, in the name of the party who pays it under the agreement. Our page on e-stamp assistance explains how the certificate is generated.
Sign with witnesses, and register if required
Both parties sign every page before two witnesses. If the term exceeds a year, present the agreement at the Sub-Registrar within four months, with both parties present for photographs and fingerprints. See our page on lease registration.
Complete the follow-up
Submit tenant verification to the local police. In Uttar Pradesh, report the tenancy to the Rent Authority within the time the Act fixes. Inform the society or RWA, and record meter readings on handover.

Stamp duty and registration in Delhi, Noida, Ghaziabad and Gurugram
Stamp duty is set by the state where the property lies. In Delhi, rent agreements are charged under the lease article of the Indian Stamp Act as applicable to Delhi, with the rate depending on the term and calculated on the average annual rent, plus any premium or advance that is not refundable. Uttar Pradesh and Haryana have their own schedules, and Uttar Pradesh has at times treated security deposits and advances as part of the value for stamp duty. Rates change by notification, so check the current schedule or take stamp duty advice before buying the stamp paper.
Registration fees are charged separately at the state's rate for a registrable agreement. The parties must attend in person or through an attorney with a registered or properly authenticated power of attorney. Several states now allow online document preparation and appointment booking, but physical attendance at the Sub-Registrar for biometric verification is still the norm.
Do not sign a long-term agreement on low-value paper with a plan to register later. Stamp duty must be paid at or before execution. An agreement executed on insufficient stamp paper can be impounded when you need it most, in the middle of a case, and the penalty can be many times the original deficit.
Rent agreements in Noida and Ghaziabad under the UP Tenancy Act 2021
The Uttar Pradesh Regulation of Urban Premises Tenancy Act 2021 replaced the old 1972 rent law for urban premises in the state. It applies to residential and non-residential premises in urban areas, including Noida, Greater Noida and Ghaziabad, with exemptions for government property, premises let by employers to employees under a service contract, and some trust and religious properties. Under section 4, no premises may be let except under a written agreement, and the tenancy must be reported to the Rent Authority, which issues a unique identification number.
The Act fixes the security deposit at no more than two months' rent for residential premises and six months' for non-residential premises (section 11), restricts subletting without the landlord's written consent (section 7), and sets out who handles repairs and maintenance (section 15). Disputes go to the Rent Authority, an officer not below the rank of Additional District Magistrate appointed by the Collector, with an appeal to the Rent Tribunal presided over by the District Judge or an Additional District Judge.
For drafting, the practical consequences are that a UP rent agreement must be in writing, must not demand a deposit above the cap, should state the agreed rent revision, and should include the parties' details in the form the Rent Authority requires. A tenancy not reported may leave the landlord without the Act's quick remedies when he needs them.
Rent agreements in Delhi: rent control, police verification and society rules
In Delhi, most tenancies today are at a rent above Rs 3,500 a month and so fall outside the Delhi Rent Control Act 1958. For these, the agreement and the Transfer of Property Act decide the parties' rights, and a landlord who wants the property back after the tenancy ends files an eviction suit in the civil court. Older tenancies at controlled rents remain under the Act, and a new agreement with such a tenant should be drafted carefully, because it can affect the tenant's statutory protection.
Delhi Police and the police in Noida, Ghaziabad and Gurugram require landlords to get tenants verified, usually through an online portal or the local police station. Failing to comply with such an order can be prosecuted under section 223 of the Bharatiya Nyaya Sanhita 2023 (disobedience of an order duly promulgated by a public servant, formerly section 188 IPC). Put a clause in the agreement obliging the tenant to cooperate with verification, and keep the acknowledgement.
Group housing societies and RWAs often have rules on tenants: registration with the society, move-in fees, restrictions on commercial use, parking. The agreement should require the tenant to follow these rules and say who pays any tenant-specific charges.
How the agreement changes with the type of property
Flats and builder floors. Add society rules, parking slot, common area use, and whether the tenant may keep pets. Describe the flat exactly as in the title deed. For a builder floor, say which floor and which share of the roof, stairs and parking go with it.
Shops, offices and commercial property. Cover fit-out period (often rent-free), signage, trade licences in the tenant's name, GST, lock-in, and the tenant's obligation to comply with fire, municipal and pollution rules for its business. A dispute over immovable property used exclusively in trade or commerce can be a commercial dispute under the Commercial Courts Act 2015, so consider an arbitration clause.
Godowns and industrial sheds. Check whether the industrial development authority or the lease from it allows letting, and whether permission or a fee is required. Specify floor load, the type of goods that may be stored, prohibited hazardous goods, fire safety, insurance of the building and of the stock, and loading and access rights.
Farmhouses and resorts. A farmhouse on agricultural land may face restrictions on commercial use; letting it for events or as a resort can breach land use rules for which the owner remains responsible. A resort is often better structured as an operating or management arrangement than a plain tenancy. Spell out licences, staff, liability to guests and insurance.
Inherited or jointly owned property. All co-owners should sign, or authorise one of them by a written authority or power of attorney. Rent received by one co-owner is held for all, and an agreement signed by one co-owner alone can be resisted by the others.
How the agreement changes with the parties
Banks and NBFCs as tenants. Banks taking premises for a branch, ATM or office usually insist on their own lease format, a long term with renewals, registration, and a right to exit on notice. The landlord should read the exit, restoration, rent escalation and strong room clauses carefully. Where a bank or NBFC holds a mortgage over the property being let, check the loan terms: a lease of mortgaged property without the lender's consent can be challenged, and the tenant may face trouble if the lender later takes possession under the SARFAESI Act.
Companies and startups. A company signs through an authorised signatory under a board resolution, and the agreement should name the registered office and GST number. A company lease for an employee's residence should state who is the tenant (the company, not the employee), who may occupy, and what happens when the employee leaves. Startups usually want short lock-ins and an early exit; landlords want guarantees. A personal guarantee from a founder or a larger deposit within the legal cap are common compromises.
NRI landlords and investors. An NRI landlord often acts through a relative under a power of attorney, which should specifically authorise letting, collecting rent and signing agreements. A tenant paying rent to a non-resident landlord has tax deduction obligations at the rates applicable to non-residents, so the agreement should record the landlord's residential status. Investors letting several units should keep the agreements uniform and track renewals.
Tax, GST and other compliance, in general terms
Rent is income of the landlord under the head income from house property, and the tenant may have a duty to deduct tax at source when rent crosses the thresholds in the Income-tax Act 2025, which replaced the 1961 Act from the 2026-27 tax year. The thresholds and rates differ for individual tenants, businesses and payments to non-residents, so check the current provisions. The agreement should record PAN of both parties and say that rent is payable subject to applicable tax deduction.
GST applies to renting of commercial property by a registered landlord, and in some cases renting of residential property to a registered business attracts GST under the reverse charge mechanism. Whether GST is included in the rent or payable on top should be written in the agreement; leaving it unclear creates a dispute the first time an invoice is raised. Ask a chartered accountant to confirm the current position for your case.
A made-up example: a three-year shop tenancy in Ghaziabad
Here's a made-up example. Sunita owns a shop in a Ghaziabad market and agrees to let it to a small pharmacy chain for three years with a one-year lock-in. The broker brings an eleven-month format. Because the parties want three years and a lock-in, the eleven-month format is the wrong tool.
The lawyer drafts a three-year lease with rent increasing by an agreed percentage each year, a deposit of six months' rent (the cap for non-residential premises under the UP Act), a two-month rent-free fit-out period, permitted use as a pharmacy only, the tenant to obtain its drug licence and fire clearance, signage subject to market association rules, and a clause that if the tenant leaves during the lock-in it pays rent for the rest of the lock-in. The agreement is stamped on e-stamp paper at the rate for a three-year lease, registered at the Ghaziabad Sub-Registrar, and reported to the Rent Authority. Three years later, when the pharmacy wants to stay on at the old rent, the expiry clause makes clear that any extension needs a fresh written agreement.
Mistakes we see in rent agreements
- Wrong landlord. The person signing is a relative of the owner without authority, or only one of several co-owners. The tenancy can be challenged by the real owners.
- Notarised instead of stamped. A notary's seal is not stamp duty. An under-stamped agreement can be impounded when produced in court.
- Long term, no registration. A three-year agreement that is not registered cannot prove the three-year term or the lock-in.
- Vague deposit refund. Without a time limit and a list of permitted deductions, refund disputes are almost certain.
- No inventory or photographs. At the end, neither side can prove the condition of the property at the start.
- Cash rent. Without a bank trail or receipts, the tenant cannot prove payment and the landlord cannot prove default.
- Ignoring the UP Act. In Noida and Ghaziabad, demanding a deposit above the cap or not reporting the tenancy can weaken the landlord's position later.
Before you sign a rent agreement
- Confirm the person signing as landlord owns the property or holds a valid power of attorney.
- Agree the term, rent, increase, deposit and lock-in in writing.
- Check whether the term needs registration and whether the stamp duty is correct.
- Read the termination, notice, repair and deposit refund clauses line by line.
- Attach an inventory with dated photographs and meter readings.
- Arrange police verification and, in UP, reporting to the Rent Authority.
- Keep a signed copy, the e-stamp certificate and all rent receipts or bank records together.
If the tenancy later goes wrong
A careful agreement does not prevent every dispute, but it narrows them. If rent falls into arrears, a legal notice for payment of rent is usually the first step. If the tenancy has to end, a notice of termination of tenancy under section 106 of the Transfer of Property Act, or the procedure under the applicable rent law, comes next. Tenants facing a demand to vacate should read the agreement before replying, because the answer often lies in the term, the lock-in or the notice clause.
If you want the papers checked before you act, the team of Advocate B.K. Singh at Legals365 can review them and tell you the next step. You can talk to a lawyer with the title document, the agreed terms and any draft you have been given.
Residential property: what changes
Residential property covers houses, builder floors, flats in group housing societies and apartments in developer projects. It is the property people care about most, and the law gives it more protection than commercial premises: consumer remedies against builders, rent control for old tenancies, special rules for senior citizens and family members. It also carries more family disputes than any other kind of asset.
The documents depend on the type. For an independent house or builder floor in Delhi, ask for the chain of sale deeds or the conveyance deed from DDA, the sanctioned building plan, the completion certificate, mutation in MCD records, the latest property tax receipt and electricity and water bills. For a flat in a cooperative group housing society, ownership runs through membership: the share certificate, the society's NOC and the Registrar of Cooperative Societies' approval of the transfer matter as much as the deed. For a flat in a developer project in Noida, Greater Noida or Gurugram, check the RERA registration, the builder-buyer agreement, the occupancy certificate, the tripartite sub-lease or conveyance deed, and whether the builder has paid the land dues to the authority, since unpaid dues have held up registration for thousands of buyers.
Stamp duty is charged on the higher of the price and the circle rate. Delhi charges women buyers a lower rate, and joint purchases fall in between; Uttar Pradesh and Haryana have their own concessions. Registration is at the sub-registrar office for the area, with both parties and two witnesses present. After registration, mutation in the municipal or authority record should be applied for, since it governs property tax and later dealings, even though mutation is not proof of title.
Disputes tend to fall into a few groups. Against builders: delayed possession, reduced area, poor construction and missing amenities, which go to the RERA authority or the consumer commission at the buyer's choice. Between landlord and tenant: old tenancies with rent up to ₹3,500 a month in Delhi are governed by the Delhi Rent Control Act 1958, where eviction for the landlord's bona fide need under section 14(1)(e) is the usual route; newer tenancies are contractual and go to the civil court or the rent authority under any new tenancy law the state has adopted. Within families: partition, wills and succession, and disputes over who may live in the house. Senior citizens can approach the Maintenance Tribunal under the Maintenance and Welfare of Parents and Senior Citizens Act 2007, which in appropriate cases has ordered children to vacate a parent's house. A wife's right to reside in the shared household under the Domestic Violence Act 2005 can also affect who stays in a property.
A few habits prevent most problems. Never buy on a GPA and agreement to sell alone. Insist on the occupancy or completion certificate. Keep original documents safe and certified copies handy. And put family arrangements about a house in writing, ideally a registered partition or family settlement, before a death or a marriage breakdown turns them into litigation.
Frequently asked questions
Is an 11 month rent agreement legal?
Yes. A tenancy for less than a year does not need compulsory registration, so an eleven-month agreement is valid if it is properly stamped and signed. It gives neither side security beyond eleven months, and renewals should be made in writing.
Is a notarised rent agreement valid without registration?
A notarised agreement for up to eleven months is valid if it carries the correct stamp duty. Notarisation only attests signatures; it does not replace stamp duty or registration. An agreement for more than a year must be registered whether notarised or not.
Who pays stamp duty on a rent agreement?
The law in most states puts the duty on the tenant unless the agreement says otherwise, but the parties can agree to share it. Write the arrangement into the agreement. The e-stamp is usually purchased in the name of the party paying.
How much security deposit can a landlord take in Noida or Ghaziabad?
Under the UP Regulation of Urban Premises Tenancy Act 2021, the deposit cannot exceed two months' rent for residential premises and six months' rent for non-residential premises. In Delhi and Haryana there is no such general cap for most tenancies, and the agreement decides.
Is police verification of a tenant compulsory in Delhi?
Yes. Delhi Police orders require landlords to get tenants verified, and non-compliance can be prosecuted under section 223 of the Bharatiya Nyaya Sanhita. Verification can be done online or at the local police station.
Can a landlord increase rent during the agreement?
Only as the agreement allows. If the agreement fixes an annual increase, that applies; otherwise the rent stays the same until renewal. In UP, the 2021 Act provides a default annual revision where the agreement is silent.
Can a tenant leave before the lock-in period ends?
A tenant can leave, but if the agreement has a valid lock-in the landlord can usually claim rent for the remaining lock-in period. Whether the claim succeeds depends on the wording and on whether the lease was registered where registration was required.
Do I need a lawyer to draft a rent agreement?
Not for every simple letting, but a lawyer helps where the term is long, the property is commercial, the deposit is large, there are several owners, or a company or NRI is involved. A lawyer also checks stamp duty and registration, which formats often get wrong.
What happens if the tenant stays after the agreement expires?
If the landlord continues to accept rent, the tenancy is treated as renewed month to month under section 116 of the Transfer of Property Act. The landlord then has to end it by notice before seeking eviction. A holding-over clause can provide for higher charges if the tenant stays without consent.
Should a commercial rent agreement have an arbitration clause?
It often makes sense, because disputes over property used in trade or commerce are commercial disputes and arbitration can be quicker. Tenancies governed by a rent control statute generally cannot be decided by arbitration, so the clause is useful mainly for tenancies outside rent control.
Is GST payable on rent?
GST generally applies to renting of commercial property by a registered landlord, and in some cases to residential property let to a registered business under reverse charge. Write into the agreement whether rent includes or excludes GST, and confirm the current rules with a chartered accountant.
Can one co-owner let out a jointly owned property?
A co-owner can let with the consent of the others, and rent is held for all co-owners. An agreement signed by one co-owner alone can be challenged by the others, so it is safer for all to sign or authorise one of them in writing.
Should I go to RERA or the consumer commission against my builder?
You can choose either, as the Supreme Court held in Newtech Promoters v State of UP (2021), but not both for the same relief. RERA is often quicker for refund or delay interest under section 18; the consumer commission can also award compensation for deficiency in service. The choice depends on the amount, the relief you want and how far the project has progressed.
Can my son be evicted from my house if he harasses me?
In many cases, yes. The Maintenance Tribunal under the Senior Citizens Act 2007 has power to protect a parent's property and life, and courts have upheld eviction orders against children in suitable cases. The parent's ownership of the house and evidence of ill-treatment are the key facts.
