Legal Support for Property Maintenance Disputes in Gurugram and Faridabad

The monthly maintenance bill arrives with yet another “special charge”, no calculation this time. Lifts keep falling, there’s no regular water supply and you receive only verbal responses from your RWA or maintenance agency. In another housing society, an owner refuses to pay because clubhouse facilities and security staff promised by the builder were never provided. Within a couple of months, the dispute turns personal.

Sound familiar? These problems arise frequently in Gurugram and Faridabad. But rarely does a property maintenance dispute simply boil down to one unpaid bill. Legal issues can range from apartment bye-laws to the handover of common areas. They may involve association accounts, quality of services or who has the power to make the demand in the first place.

Resolving property maintenance disputes in Gurugram and Faridabad requires understanding who can levy a charge; what the society bye-laws or deed of declaration says; whether common expenses were properly allocated; and which forum has the power to adjudicate the complaint. Often when Advocate BK Singh starts looking through paperwork, he finds the root of the problem buried in misplaced emails, minutes of meetings and payment history not just the most recent demand notice.

Owners are concerned about late fees, restrictions on their space, recovery proceedings and how outstanding payments will impact a future sale. But RWAs are also under pressure: unpaid dues from members can affect the society’s cash flow for guards, lift and pumps maintenance, garbage collection etc.

Which legal avenue is best depends on the parties involved, the stage of the project, the nature of the relief sought and what the documents say. One forum cannot resolve every maintenance dispute. That’s why BK Singh Advocate treats the first consultation as a fact-and-document discovery exercise. Making accusations too early can often complicate a legitimate grievance.

Why Do Property Maintenance Disputes Matter in Gurugram and Faridabad in 2026?

Disputes around maintenance impact daily convenience, safety of shared facilities and the monetary wellness of a society. Anything, no matter how petty, from a billing issue can escalate to affect hundreds of flats in Gurugram and Faridabad.

Fights around ambiguous maintenance charges, lack of upkeep in common areas, delay in handing over the society to an association, contested sinking funds, parking regulations or selective fines are the most anxiety-inducing cases we see. Residents are likely to receive conflicting information from promoter, RWA and facility management company. When residents are left clueless about where they legally stand, mistrust spreads quickly, long before they file a case with an authority.

Your Gurugram society might fall under Haryana RERA (since it works on territorial jurisdiction) at Gurugram but another legitimate complaint could be directed at consumer court or civil courts instead. Jurisdiction depends on many factors such as location, registration of project, wording of your contract and the service provider in question. BK Singh Adv copies do not view “RWA dispute” as an exhaustive cause of action.

Common problems residents report

Unit owners are charged according to super area when they think the governing documents specify a different method. Owners are charged for facilities that are not completed or are closed. These are issues of authority, computation and promised amenity exacerbated by unavailable records. Shared control is another issue. The builder claims turnover has occurred. The association says not true. The maintenance company continues to bill. Owners don't know who to question or pay. BK Singh Lawyer documents the dispute. We do not presume that failure to provide service voids all payment responsibilities.

Quick Facts

  • Haryana Apartment Ownership Act, 1983 – acknowledges common expenses and ties the share of contribution to owner’s undivided interest as per the governing document.
  • Owner of an apartment cannot generally escape from his/her lawful contribution on the pretext of not using the common facility.
  • Billing can be materially impacted by declaration, deed of apartment, bye-laws and terms agreed to in builder-buyer agreement.
  • RERA complaints are specific to promoter’s statutory obligations, project commitments, handover or any service associated with a registered real-estate project.
  • Cases under Consumer Forums can arise where a paid service is alleged to be deficient or subjected to unfair trade practice, depending upon maintainability and facts.
  • Civil courts can look into contractual, declaratory, injunctive or recovery claims where jurisdiction is not attracted away from lawfully.
  • Choice of forum and Limitation would depend on each case. A demand notice should not be dismissed.

What Is the Core Legal Issue in a Maintenance Dispute?

Essentially one must analyze if the demand/service obligation/restriction is valid under the governing law and project documents. A maintenance issue may relate to existence of liability, quantum charged, allocation formula, quality of service, access to accounts, authority of money charged etc.

Liability and service default are often interlinked but not always. Complaint by an owner of poor service does not ipso facto establish that no common expenses were due. Similarly, just because a demand is termed “maintenance” does not make it legal. Advocate BK Singh analyzes each head of charge, the period for which it is claimed and the entity liable during that period.

Individual vs common repairs often get mixed up too. Leakage could have arisen from an individual unit, structure or common sewage lines. Instead of finding out who had control over the source of damage parties start fighting..

Which Laws Can Apply to a Haryana Property Maintenance Dispute?

Combination of Haryana apartment Act, RERA, Consumer Law, contract and general civil remedies is possible. BK Singh Lawyer analyzes where the grievance fits against the obligation that has allegedly been violated.

Haryana Apartment Ownership Act, 1983

The Act includes definitions for common areas, common facilities and common expenses. Section 6 governs common areas and facilities. Section 10 describes allocation of common profits and expenses by percentage of undivided interest. Section 16 allows bye-laws governing administration, maintenance, repair and replacement of common areas and facilities and collection of common expenses. Section 18 addresses a favorite argument of ours: An owner cannot avoid paying his or her share of common expenses by waiver of use of common areas or by abandonment of the apartment. It does not mean that you can impose an arbitrary or unauthorized charge; it explains why "I don't use the gym" may not be a cure to the legal problem.

Real Estate (Regulation and Development) Act, 2016

Promoter owes statutory duties under section 11(4) including provision of requisite services at reasonable charges till the maintenance is handed over to association of allottees and formation of such association is completed. Section 17 deals with handing over of title, common areas. Section 19 deals with recording of rights and obligations of allottees including right to participate in formation of association or body and obligation to pay the amount due under agreement.

Suitability of RERA would be highest where dispute is directly against the promoter, on a registered project, over promised amenities, maintenance before handover or transfer of common-areas. If dispute is internal to association, you may have to explore other options. Please visit Legals365’s verified page on Haryana RERA services.

Consumer and civil law context

Consumer Protection Act, 2019 could become implicated if a consumer claims a deficiency in payment of housing/maintenance services. Whether a claim under the CPA is maintainable depends on the relationship+purpose +relief sought+ evidence ; consumer forum is not a catchall RWA tribunal ...Whether contractual clauses/Indian Contract Act, 18 72 /Civil remedies can become relevant in a suit for recovery/ accounts/declaration/injunction...etc. Interim relief is discretionary & based on pleadings & evidence. Adviser Advocate BK Singh separately from criminal prosecution.

When Should You Consult a Property Maintenance Dispute Lawyer?

Seek advice when a demand includes unsubstantiated dues, double fining or an impending recovery proceeding. Guidance is also recommended when critical services for common amenities are severely impacted, maintenance accounts are repeatedly withheld or builder and society seek exemption for the same period.

Immediate action is required when threatened with loss of possession, denial of access/utilities, title/pending sale documents or a limitation issue. Take every notice seriously, they may not always be legal but don’t disregard it. BK Singh Lawyer can review the notice, documents & forum before people take firm stand.

Your RWA or association may benefit from a legal review when its jurisdiction, method of calculations or decisions are questioned by several unit owners. Builders & facility managers may also require legal guidance where records are incomplete upon handover or when responsibilities are unclear between contractual parties. Group grievances require tactful distinguishing between society premises & individual unit facts.

How Can Legals365 Help With a Maintenance Dispute?

Legals365 can help with collating the record, identifying parties, reviewing governing documents and mapping each contested charge/service complaint to an underlying legal obligation. Without promising any outcome, we can turn a barrage of maintenance grievances into a legal compliant brief. Advocate BK Singh can then assess if the matter is seemingly promoter/association led, contractual, consumer facing or largely civil. That assessment may include review of any notices, responses, computations, documentation gaps and representation (before the relevant forum) if you’d like. The Advocate’s verified service page covering property law also outlines his wider real estate practice.

Of course, if the residents are dealing with harassment or time pressure, just an initial call can help you understand what exactly the papers establish as opposed to what you’re disputing. BK Singh Advocate also reviews records for RWAs and other stakeholders as required. No legal strategy can guarantee a result and each legal position is dependent on the project’s record.

Frequently Asked Questions

Q1. Can the owner stop paying maintenance due to poor services?

Ans. Service and payment liability are two separate legal issues. Absolute non-payment would likely cause arrears to build up while the service complaint will still need to be substantiated and evaluated in accordance with the governing documents and laws. Do read all demand and service record together before taking any further step.

Q2. Can RW A charge maintenance on Super Area basis?

Ans. It depends on the declaration, deed, bye-laws, terms of contract and Haryana state law. Labeling a bill does not make it valid. Validity of the adopted formula and authority under which it was adopted needs to be seen.

Q3. Who should pay maintenance until society handed over?

Ans. Owed depends on stage of the project, nature of agreement & statutory obligations. Until the Association of allottees take over, promoter is responsible for essential services under RERA. However, facts regarding possession, handover, purpose of charge would matter.

Q4. Can maintenance be charged on unoccupied flat?

Ans. Merely because a flat is not occupied, common expenses that are legitimately due won’t be waived away. Section 18 of Haryana Apartment Ownership Act, 2014 deals with waiver by non-use or abandonment of apartment. However, if the demand itself is not properly made/ calculated, the entire demand itself can be challenged.

Q5. Where to file maintenance dispute in Gurugram?

Ans. Complaint can be made to Haryana RERA Gurugram or to a consumer forum or to a civil court having jurisdiction. The appropriate forum would depend on the respondent against whom complaint is made, where cause of action arose, what relief is sought and under which law the complaint is made. BK Singh Lawyer checks for maintainability of complaint before filing the same.

Q6. Which forum is proper for Faridabad RWA dispute?

Ans. Faridabad is not the determinative factor when deciding the proper forum. Nature of the association whether registered or not, project documents, parties involved and relief sought would determine whether a civil lawsuit, consumer complaint, RERA complaint or any other statutory remedy is possible.

Q7. Can association charge interest or late fees?

Ans. Interest or late fees have to be sourced from the governing documents/valid resolutions passed or from the applicable law. The rate of interest, period for which it is to be charged, proper notice etc. would have to be seen. Additionally how the association has been charging interest in similar situations would be relevant.

Q8. Are whatsapp chats admissible as evidence?

Ans. WhatsApp chats would help establish chronology. But sending party would have to be established. Keep a copy of the entire chat on your cellphone, instead of giving a cropped screenshot. Related documents and also phone records would help prove your case.

Q9. Can multiple flat owners complain about the same maintenance issue?

Ans. Issues common to all can be raised together. But individual ledger account and facts related to specific units would be different. BK Singh Advocate segregates common questions from individual claims prior evaluating the claims jointly.

Q10. How long does maintenance case take in property matters?

Ans. There is no shortcut answer to that. Pending load in a forum, proper/service of notice, interim applications, evidence, sets to appeal etc would impact timelines. Also check separately for Limitation period, if any.
